Going to apply for family permit need help

Going to apply for family permit need help

Hi every one..I am from India came in UK on the basis of 5 years work permit in nov 2003 , worked in the field about four years ,and have been paying tax , 2 weeks ago i got married , my wife is from Poland, she came here about one year ago and since than she has been working full time. i left my job 3 months ago ,had plan to move to London, but following week had a car accident and hurt my back since than i am not working, and cant work in the future as well because of the nature of the job which require a lot of physical work. and according to the work permit terms and conditions i am not allowe to work in any other field.
Now i ll be realy thankful to you guys if you help me , i read the other posts related to family permit which says that i need 6 months payslips which i dont have, would it be a prolem to get a family permit while i am not working at the moment.
secondly which form do i need to use, and what docoments.
and how long the home office take to issue a family permit.

Where will you be applying from?

If you are in the UK, you won't be applying for an EEA family permit. See also European Casework Instructions, Chapter 7 - Accession State Nationals. Depending on your wife's status, you will be applying on either form EE2 or form FMRS.

Thanks for reply...i am in the uk and going to apply from here my wife is polish working here since last one year...

If your wife still registered on the WRS? If so you should use form FMRS to apply. But if she has already "served her time" on the WRS and now has a Residence Permit, it is form EEA2 that you should use.

Thanks John, Yes she is registered on WRS , and served her time aswell but hasn't apply for resident permit yet..is it possible that we can both aplly at the same time??

Yes, I would say so. So she submits a form EEA1 and in the same envelope you enclose a form EEA2. Perfect!

Won't this cause a problem as the OP doesn't have a spouse / family permit yet and leaving the job while on the WP invalidates the WP?
