Can I use my wife's pay for the financial requirement?

Can I use my wife's pay for the financial requirement?

Hi there,
I am in between jobs at the moment and about to apply for FLRM - spouse visa indefinite leave to remain.
Can I use my wife's salary for the financial requirement? If yes, how much does she have to earn to cover me?

A minimum of £18,600 annual earnings.

I saw this is the requirement for myself, but is this the same if I use my wife's income instead? Is that allowed? She is a British Citizen and earns enough for both of us.

There's absolutely no problem using your wife's income alone to qualify for FLR(M). Joint income is also acceptable.
Edit: I note that you've contradicted yourself. Are you applying for a 2.5 year FLR(M) extension, or SET(M) for ILR :?:

That's fine, just wanted to check you were on the right track. The advice I've given regarding earnings would be the same for both applications. Unless you're exempt from the English language test, make sure you submit a qualification from an approved test/test provider on the updated list.

Oh wow, that's all a bit crazy. Thanks very much for all your help - much more helpful than the guidance notes for the application!
Just quickly, how long can someone enter the UK with an Australian passport for if they're entering for tourism and not working?

A visitor visa permits up to 6 months stay, although the Entry Officer is likely to want to see an application for less than this for a genuine visitor.

Thank you for all your help! Just one more question sorry - do we have to leave the country at all to apply for an FLR(M) ? If so, does it have to be back to our home country?
Or can we just stay in the country when we apply and when the visa clicks over to the new visa?

FLR(M) is only applied for from within the UK. The next 2.5 year extension follows on from the first and the applicants legal status remains the same while the application is being decided...however long it takes.

Okay thank you very much. I wasn't sure as I am currently on a T5 Youth Mobility Visa and would be moving on to FLRM. I've been reading some very contradicting things, just trying to weed out the wrong information I've seen around.

You can switch from Tier 5 to spouse on FLR(M) without leaving the UK.

Thank you, just one more sorry.. I think I read on the application that I can send a copy of my wife's full passport. Do I need to send original copies of my passport and current visa, or can I also provide a full copy of my passport and visa?

If you are the applicant, you have to send your original passport. British sponsor, copies is fine.

If you can't be without your passport for a few months, suggest you pay extra and apply in person for a same day appointment and decision.

Hi there, I have a quick question for question 3.15 is your partner British from birth.. My partner has a British passport as her father is English. She was born in Australia though. Do I count that as British from birth or put in that she has a passport via British father? Thank you!!

Yes, she is British by birth.

However, as she herself is British by descent, her children will not be British citizens unless born in the UK.

And they will need to be registered as Australian citizens if you wish them to retain an Australian identity.

Just one last question - I couldn't see anywhere on the form to say if we're going for the two year route or the five year route. Is there anything we need to do to apply for the five year? Is the cost and all the information required the same as the two years?

There is no 2 year route. This first FLR(M) visa will grant you an initial 2.5 years and you will then have to apply for a further 2.5 year extension before qualifying for ILR at the end of the 5 year period.
