Dependant on British citizen or Tier 1?

Post by RS1987 » Mon Mar 21, 2016 2:44 pm

I am currently on a work sponsored Tier 2 visa. However, as my employer can no longer extend my visa, I need to become a dependent on my husband. My husband is now a British citizen but was originally on a Tier 1 General visa. I am confused about the dependent category that I should apply to now (I am not worried about re-setting my clock as I am due to complete 10 years and can apply for the Long residence visa soon).

Any ideas on which category dependent I would be? Is it:

Tier 1 dependent or FLR (M) or something completely different?

I would be very grateful for any guidance!!

You only have the option of FLR(M).

You would have needed to be his Tier 1 Dep already to continue in that category.

But the FLR (M) guidance note says: You must not use this form to make an application for an extension of stay in the following categories:
 As the partner of a person granted indefinite leave to remain in a work route, if you are currently in the UK as their dependent.

I am not currently their dependant. I just want to confirm that I am understanding this correctly.

So as I'm not his dependant currently, I qualify for FLR M?

You are not and have not been your spouse PBS dependent so you can only apply on FLR(M).
