Spouse Visa accommodation requirements - council house

Post by yeshh » Wed Mar 23, 2016 2:50 pm

Hi,
I am a student currently living with my parents in a council house. My parents rent is paid by housing benefits. In a few months, my husband and I plan to apply for Spouse Visa. I plan to live with my parents when my husband arrives until we find suitable accommodation for ourselves and when I graduate and find a job. There is also enough space in our flat and if my husband will need to pay rent, that wont be a problem as he has savings.

Is it possible for my husband to live with my parents as its a council house? Also, what evidence would i need to provide to support our application?

You cannot apply for a spouse visa if you do not meet the financial requirement of £18,600pa or have substantial savings of £62,500.

In order to live with your husband in your parent's Council accommodation you will need a formal letter of agreement from the Council as the landlords.
You will also have to submit your parent's tenancy agreement and evidence that the flat is 'adequate' and won't be overcrowded if your husband lives there. Be aware that this may affect the housing benefit your parents are currently claiming.
