Is everyone in Ireland required to have medical insurance?archigabe wrote:Proof of Medical insurance for you and your spouse.
My spouse is an EU citizen who is exercising EU treaty rights by working in Ireland. Because my spouse is working, there is no requirement in either EU law or in Irish law for me to have medical insurance. For Irish law see specifically European Communities (Free Movement of Persons) (No. 2) Regulations 2006 - S.I. No. 656 of 2006 - Residence in the State - Section 6 (2) a and 6 (2) b. You can confirm this with the legal affairs coordinator of the Treaty Rights section of DOJ.
I know of no legal requirement that I show proof of medical insurance as a requirement for the EU1 application to go ahead. I would therefore request that proceed immediately with processing the application that that it can be issued within the legally required 6 months.
Should you have any questions or can indicate the legal basis of your request, please do not hesitate to contact me.
