when can we apply for ILR

After coming back from a legal aid immigration lawyer, who falsely informed us that my British spouse and I couldn't claim child tax credit we decided to pay for another opinion through a link on this site.

The lawyer answered our question and then voluntarily gave us information that after our 2.5 spouse D visa that we could extend the visa and then apply for ILR after 3 years of being in the uk as I am married to a UK citizen and therefore that is what I should be aiming for. I was under the impression that I had to apply for another 2.5 year visa before i could apply for ILR (staying in the UK for 5 years in total). is this correct, I feel that every lawyer we speak to is giving us false information.

I got married in 2009 in Morocco and I moved to the UK with my wife in November 2014 under the 2.5 years D-Spouse visa.

You need another 2.5 year extension. You have to have 5 years residence before you can apply for ILR.

If you only came in November 2014, you are under the new 5 year rule.

Why do you keep saying Spouse visa D? What exactly does your visa say?

Because in my visa it states on the type: D-Spouse/CP
Am I wrong calling it a D-spouse visa? Do you think there is any issue relating to how they printed/called it on my visa?

No one usually calls it that and my spouse visa was a biometric card.

You need an extension to make 5 years residence. There is no quicker route.
