Hi all, am glad to come across your website and here is my story. I met my wife just over a year ago when I came over to study in Sept 2014 and we got married 7 months later and have been happy each day we have known each other. On the 11th of January we applied for a spouse visa (same day) and was refused with the right of appeal on human rights ground to which we did. My wife is self employed and has been for over 4 years, her business is a cash in hand business and as such does not feel the need to bank all her earnings (she just deposits enough to cover her billls). When we applied we provided the deeds to her house which she owns, her self assessment tax payment receipts the HMRC, audited accounts from chartered accounts for the 9 months prior to the application and predicted values for the next 3 months, our bank statements, national insurance contributions, and registration of the business as been self employed. The grounds to which the visa was refused was because she did not bank in all her earnings ( she banked 13000). We appealed the decision in time and we are awaiting an appeal date presently. My question is do we have a chance at the appeal as we have tax payments from when the business started which shows she has always earned above the threshold, or do we make a deposit which would meet her earnings and make a fresh application immediately the appeal is withdrawn?. Or do we just go to Ireland and use the Surrender Singh route which would avoid the hassle of paying such high application fees and forego the financial requirement?. My Dad recently passed away few days ago, have been sad and devastated. Does my 3c leave allow me to travel out and back to the country should the appeal date be later than the burial?..
