My wife’s initial spouse visa will expire on the 23rd of April 2016 so it’s only 17 days away. She has passed her A1 qualification and I will be paying the health surcharge in the next day or so. My current situation means that if I were to send the application off today I would only have 5 months where my salary satisfied the £18600 salary rule. Due to back problems I have been unable to work full time meaning that I have not met the criteria throughout the course of the visa. I only went back fulltime in November so I’m at a loss as to which way I go. If I wait up until the final week of the visa I can get the 6th month (April) to satisfy the salary requirement, but it will be clear if the home office check my wage slips that the earnings to date don't satisfy the £18600 rule. Are they bothered about me satisfying the salary requirements for the entirety of the visa or just the 6 months prior to the application?.

I do however have considerable savings and am wondering if I should apply with a combination of income + salary. If I go back 6 months from today I would have had £70,608.01 in savings. If this is the case taking into account the rule where you ignore the first £16,000 would I satisfy their requirements?.
My current situation is that I have over £ 75 k.

Is it preferred that one satisfy the income (via work)? Or is a combination of income + salary just as acceptable?.

Since we will be applying at some point this month we will be unable to provide this month’s bank statement as these normally arrive in the first week of the following. On page 64 it states no cashpoint statements are accepted how do we overcome this? I was hoping to pull off a ministstement and get the bank to stamp it would this be acceptable?.

I would also appreciate if you can clarify some things off the flr(M) form. Forgive me if some of the questions seem silly but the wording of some off the questions leave scope for potential errors.

• IHS - Are you supposed to pay for this prior to application or can you provide payment with the form/ application?
• My name is spelt differently on my birth certificate. Is mentioning it enough or do I have to provide my original birth certificate.
• section 2 - Can you confirm that I am applying under the following option..., spouse of a person present and settled in the uk and a biometric immigration document.
• 2.2 - which category to apply under...,
yes or no (this is an extension of an initial spouse visa so am I write in ticking no?.) Since this is the second period of leave to remain. All the options seem to have some aspect that is correct for example the very next option mentions that this is your first application in the uk but the next part of the statement is incorrect in that she (my wife has had permission enter as a partner).
• 4.4- Q-Fill in if you have answered yes to 4.1/4.2and 4.3 Please provide details of children applying with you first...,
I have only answered no to 4.2/ 4.3 but answered yes 4-1 so do I have to fill in the table 4.4 ?. Our child was BORN IN THE UK. Should I even be filling in this section or can I move onto section 5?

if I put by air is that good enough or do I need to provide flight dates tickets etc.
• 6.7 -QWhen did you start living together..,
We lived in our family home for 3 weeks in Pakistan (after our marriage)do I need to include this or do I just write the time spent together in the uk?.
• 6.33 shared financial responsibilities? Does our 2 year child old mean we tick yes?

FINANCIAL REQUIREMENT- as stated earlier should I go with salary alone or do I go with salary and savings.

• Date of application? Is it the date that we send off the application or the date we sign on the application? I ask this because it asks on a numerous occasions.
• 9.12 Q-have you had your finger prints taken as part of a previous UK immigration application made in the UK or abroad? my wife can't remember if she had it for Pakistani id card or part of the application, nor is she able to recollect the date so do we say tick yes or no

Section 12 Does my wife need to hand over her Pakistani passport and her Id card or just the passport? She only used the passport to get here so do we just hand in the passport?.

As the spouse I will be photocopying every page of my passport and sending it in. Do I need to have every page attested by a solicitor or can I get away with just providing a copy.
Would it be advantageous to send my passport in?

Correspondence-

We live with my mum and dad and are in the process of completing the purchase of our family home from the housing association. The house is in owned by me and my mum/dad. It’s all paid for. The only snag is it has not been registered because of an issue with the rear fence is stopping us from having the home registered with the land registry. Therefore we have no deeds.


We don't have the necessary 8 items of evidence (4 in joint/2 in each of our names) we have water bills (X3). Childs birth certificate. We have plenty of junk mail asking us to take this loan /sign up for this credit card etc. I intend to include a letter from my parents stating that most of the bills were in their names. If I include multiple copies from the same source is it acceptable e.g. 3/4 bank statements?

On occasions the form states one has the possibility of further explaining an issue on a seperate piece of paper. Are we then supposed to affix this between the relevant pages or at the end of the application form?

How do we post it to them? Is there a preferred method (which is safe/ reliable?)

What format do we use? Can I send a file with each page in a plastic wallet or do I staple the whole application together?
I've heard that I need to photocopy every page and send them aswell is this true?.

I'm trying to figure out how I get the photos /certificates etc. to them without them getting lost!!

Do I need a sponsorship declaration / home inspection report?.

Section 14- Do i the sponsor have to sign the declaration? Does this only refer to bank accounts or does it include the likes of water bills?
