Soon I am about to submit EEA2 application to HO for residence card. I am non-EU family member of EU-citizen, who is living and working in UK. Currently I am holding EEAFP. My spouse has 2 criminal records (which are unspent). My spouse has never been deported on these grounds but has some restrictions on staying in UK, such as limited leave to remain being issued every year for 1 year. In October 2008 my spouse finally is going to get indefinite leave to remain.
I also have to mention that defferent department deals with my spouse`s documents for a stay in UK and information is suppose to be classified.
In application form they ask to name ALL criminal records. Should I mention them or not? If I mention them, HO may start digging into it to find out more and also find out that my spouse`s limited leave runs out in October and as a result - issue Residence Card just for these period. And then I will have to apply again and wait another 6 month.. Or may be it is the best to mention criminal past but send my spouse`s ID card instead of passport?
