EEA Permanent Residence card and PR for Family member

Hi all,

I am a non eea family member and I would like some help on my current situation . My partner (french) came to uk in 2006 (may) and has been here since .. He worked between 2006 -2011 with minor breaks in between when he was a job seeker . He then stopped working in February of 2011.. Then in September of 2011 enrolled as a student and has been to this date .i arrived in Uk in 2009 on working holiday visa . Entered into civil partnership in January of 2011 and have always been employed from first entry in the uk to this date ..

My partner and I made a joint application for PR on the 31st of March .through solicitor . On the basis that he acquired PR in 2011 from continuously excercising treaty rights from 2006..

My partner and I lived together until 2013 . We never divorced and are on good terms .he has no comprehensive insurance for the time he has been a student .

We submitted documents from his employers then , Hmrc employment history , joint bank statements , letters confirming cohabitation, photos of life together , his documents as a student and any documents of benefits ..

Could you please advise on the stengh of the case . And if refused will I be able to apply for another residence card .my solicitor advised to get divorced and then apply for PR under retained Rights .. Could any one advise on possibly options ..

All help is deeply appreciated..

When in 2006 did he start working?

The reason for that question is that to have acquired PR in 2011, he needs to have either worked or sought work for five continuous years. If he wrapped up at say 4 years and 11 months, he will not have acquired PR.

Between February 2011 and September 2011, did he have Comprehensive Sickness Insurance?

He started working in May 2006.. He finished in Feb 2011... Was job seeker between March and August 2011.. And then in September went on to study .. But he did not have CSI...

Does student/sponsor have a RC issued as a student in 2011?
That does away with need to hold CSI due to a transitional arrangement that may be invoked (subject to certain conditions).
