Can I submit a new application once appealed

Hi,

My fiancé applied for FLR(M) which was rejected on a technicality and we appealed back in January (still not heard back).

We are now getting married next month (been home office approved) and wish to send in a fresh application in May, can we do this and would the appeal automatically be discarded and the new application looked at on its own merit ?

I realise we would have to pay a new application fee plus health charge, but was concerned that the appeal may interfere with the new application, can you please advise me. Also if the appeal would interfere with the fresh application can we just cancel the appeal ?

You have to withdraw the appeal and get confirmation of withdrawal before you can submit another application.

What was the reason for refusal that you say is a technicality?

Thanks for the advice, can I e-mail the courts advisng that I am withdrawing the appeal and ask for confirmation to be sent ?
