Discretionary stay dependant application inc child

I am on my discretionary stay until 2017, I got married to a tier4 student and have a 3 month old child now, my wife's visa expires next month and I would like to apply for her visa as my dependant. I spoke to solicitor and she said I have to apply using the FLR(O) application.

Can someone please help me out on the application forms I should use for my wife and my child? And the please explain the procedure too.

my wife will be applying for dependant visa along with my 4 month old child born in UK, i have a discretionary leave to remain until 2017,

will i need a passport for my child?

I hope you aporeciate that a person on DLR cannot be a sponsir of any person, within the immigration rules. DLR holders cannot sponsor spouse or children.

You can only hope for a grant of leave outside the rules to your spouse and child. Passport is required for the child, unless there are good readon why it could not be obtained.

FLO (O) seems like a wrong application for Article 8 cases.

If Sri Lankan authorities accepts it, then fine.

If child is not travelling, then neither a passport nor a leave to remain application is required.

My Wife and my 9 month child applied for an FLR(o) last october and we got a reply today saying the application has been rejected invalid as we havent paid the health surcharge. my wife's visa ran out october last year and the child was born here.
the letter says that my wife has to leave the country within 7 days. it also says that they will refund the application fee, which i havent received with the set of documents they have sent. they have not sent my wife's passport and my child's birth certificate.

1. can i reapply with the same application and paying the health surcharge of course.?
2. will i get the refund?
3.or is better to go back to home country and apply again?

Considering the fact that you are unable to sponsor either your wife or child's application, under what grounds was FLR(O) submitted? Obie advised against an FLR(O) application as the case appears to be under article 8.

Well you have only yourself to blame, as FLR (o) is the wrong application, and secondly you failed to pay the surcharge.

Did they not write to you giving a SINGLE OPPORTUNITY OF 10 BUSINESS DAYS to pay the Health Surcharge? Just Wondering if they didn't, would you not be able to ask for it saying why you were not given that opportunity!!

Just wondering if @Obie or anybody with knowledge in could shed some light on it regarding the "Single Opportunities of 10 Business Days" practices by the UKVI before invalidating an application.
