Hi,

For those who were accused of fraudulently obtaining TOEIC and made a voluntary return, do they face any re-entry ban when they apply again? If someone made a VR over a year ago and now wants to re-apply as a dependent of a Tier 4 student studying at a popular university, how good are their chances of getting the visa? My understanding is that those who are accused of submitting fraudulent documents in their leave to remain, if they return voluntarily on their own expenses, they face a one-year re-entry ban? Is this true? What do the rules say on this? Any advices from senior members will be highly appreciated.

UK Govt recently lost court case regarding TOIEC/ETS.

Persons involved are now victims so environment should be more 'welcoming' should you choose 'to come in from the cold'.

Thanks a lot for the reply noajthan. I am aware of the TOEIC case and I am keeping an eye on the progress. Meanwhile what I wanted to know is the worst case scenario. I appreciate that the deception case shouldn't have such bad effects any more on a person's profile as it had a couple of months ago but regardless of this, What's the duration of re-entry ban if a person is accused of using fraudulently obtained TOEIC. My understanding on the rule is that you get an automatic one year re-entry ban. The person I am talking about went back to his home country around an year ago and wants to apply now as dependent of a tier-4 student. After going through the re-entry ban rules, I am under the impression that because he made a voluntary return, the maximum automatic ban for him is one-year which he's already almost spent outside UK. Should he now be OK to apply ?
