Baby born in India what to apply?

Baby born in India what to apply?

Hello All,

My baby is born in India last month and currently I am on ILR as well as my wife. I am going to be British Citizen on coming May 3rd(Attending the ceremony) but my wife is still going to be on ILR.

I would like to know what can I do for my child to get him over to UK? Can I apply for a British Passport directly based upon my British Nationality using my Naturalization certificate?

Or get Indian passport for my child and apply for a dependent visa?

Please do provide more information on what applications or visa I need to apply for.

You are not yet British and your child is not British as he was born abroad before you become British on 3rd May. Only British citizens can apply for a British Passport. If the child had been born IN the UK, the child would have been automatically British.

Or get Indian passport for my child and apply for a dependent visa? This is your only options. Indian passport and child settlement visa.

Just another question, what is the case if I start the process after me becoming British Citizen will my child not be eligible for British passport? or still I need to get him a Indian passport and apply for dependent visa?

A parent acquiring British citizenship after baby's birth does not change the baby's nationality.

The status of children born abroad is generally in line with that of the less-privileged parent.

As your wife (the less-privileged parent once you get British citizenship) has ILR, the child should be eligible for ILE. The child will be an Indian citizen only and hence will have to apply for an Indian passport first.

The child can be registered at discretion under section 3(1) on Form MN1 at any time after you get British citizenship. The chances of success of the child's registration are higher if the child's application is submitted with or after the mother's naturalisation application.
