Refused RRR(Retained right of Residence) futher action

Dear Sirs,

I found myself in the situation where no one can give a definite answer...The last hope is your website which was helping me for past 5 years.

I have applied for RRR after separation with my partner in September 2015 and on the 1 March 2016 received a refusal letter saying that you met all the requirements ( civil partnership lasted 3 years, never claimed benefits, all the time both of us were working and paying taxes and living in the UK), but you failed to notify Home office that you left your job in December 2015 as upon contacting the company we were told that you don't work there anymore.
It is entirely my fault as I missed that fact that I need to do it...
Yes, I left my old job but got the new one straight away with better salary.
There was an appeal form to Tribunal which I filled and send it away.
My question is - on the 9th March 2016 I qualify for Permanent Residence 5 year route(4 in partnership and 1 year on my own) can I send a new application for Permanent Residence or I need to wait for the Tribunal decision?

Whilst the result is dissapointing I think you can take positives in that you know you meet the requirements. Considering you've acquired PR in March, you should put in an application for PR.

In the refusal letter sent by HO it says if you wish to apply in the different category you are welcomed to do so, but my only hesitation is how can I apply for PR if my Retained Right was refused....

You can apply for PR with evidence of your (eea) ex up till divorce + your (non eea) up to date evidence of treaty rights after divorce.

To flesh out Carling40's answer, you were refused the card evidencing the right, not the retained right itself.
