Need Help on Spouse Extension

Need Help on Spouse Extension

Hi,

I thank all the moderators and contributors for answering all my questions.

I need help on my spouse's visa extension. Currently, I'm British Citizen and wife came as my dependant whilst I was on ILR. Her status:

Issue Date: 22-Jan-2014
Expiry Date: 22-Oct-2016

Please can you answer following questions:

1. I assume that she needs to apply via FLR(M) (https://www.gov.uk/government/publicati ... -form-flrm)?

2. Can she apply 3 months before the expiry date? If not, what is the earliest date she can apply?

3. Is there a document check list please?

4. She isn't working for last one year, does it matter at all?

5. How much bank balance do I need to show, she is sole dependent?

6. She needs to pay extra £500 for NHS right?

I really appreciate your time and help.

Will she get 2.5 years or 2years and 3months because her initial visa was given for 2years 9months?

3. Is there a document check list please? Read through the FLR(m) guide. 6 pieces of evidence in joint names showing proof of address, spread as evenly as possible throughout the 2.5 year period. We just have council tax as joint document. Maybe I can open a joint bank account? But she has her own:

i) Bank Statement
ii) Credit Card Statement
iii) Driving License
iv) Voter Letter from Council confirming our names and address
v) Letter from NHS
vi) Council Tax
vii) Previous House Tenancy Agreement (Current home we bought and it is under my name)

Does the above documents meet the requirement of six different evidences showing same address? And I can produce six documents with same address right?

If you don't have 6 documents covering the full period in joint names, you'll have to find 12 in single names. Opening a joint bank account now, won't prove 2.5 years of joint address.
The FLR(M) visa will be issued to 2.5 years. The original visa was issued for an additional period to allow time to enter the UK.

Sorry one question please - Does it have to be 6 DISTINCT documents covering full period? I mean let's say, if we have Credit Card Bill for 2.5 years period i.e. multiple bills of Credit Card, does it count as one document? I'm a bit concerned that I might struggle to produce 6 distinct documents.

Can I use our baby's birth certificate as a proof as well? As we will have our full names on this document.

Each bill will be considered as a separate piece of evidence, but the total submitted must be from at least 3 different sources.
The birth certificate will only qualify if it shows your address.

Understood. Thank you so much. I really appreciate all your help and advice. I've spent 4 hours and found following documents which has old and new addresses on wife's name:

NI confirmation
Electoral Registration
Thames Water
Bank Statement
Credit Card Statement
Driving License
Co-Operative Energy
NHS Letters
Southall Travel Invoice
Tenancy Agreement
Life Insurance
Company House Letters

Does any of the above documents are not qualified as a evidence? I made sure that all of the above documents either have old or new address.

Anything with a name and address will be accepted. Are the documents you've listed in your wife's name alone? If so, what do you have in your name?

Hi again - One question on income proof. Do I need to show last 12 months from (Aug -2015 to July - 2016)? Can I show from June-2015 to May-2016? Is that acceptable too?

You need to submit 6 months pay slips + the corresponding bank statements with the most recent being no older than 28 days prior to submitting the application. You can include joint income if your wife is working.

Thank you Casa. If I include only last 6 months then my income WILL NOT be £18,600. I thought I can show annual (last 12 months) earnings of £18,600. Is this not right?

I read it from FLR(M) document and it states on page 26: "an income before tax of at least £18,600 a year"

The reason I'm concerned is that - I have earnings as director of limited company from dividends and my last 6 months salary is not more than £10K.

Am I missing something here?

In which case I believe you can submit last 12 months, but wait for confirmation from others with a more comprehensive knowledge of director's earnings with dividends to confirm.
