Travelling to Pakistan with Humanitarian Protection

Post by AhmedZ » Sun May 15, 2016 2:20 pm

Hi All,

I would be grateful if some can advice me on this matter.
I have been granted humanitarian protection about 4 and a half years ago for 5 years. I would like to visit Pakistan as it is a matter of urgency.
Would it be possible to do so at all.
Thanks

Did you apply for humanitarian protection based on circumstances in Pakistan??

What is your nationality?

See page 13, point 8.1 in the link below on Revocation of Humanitarian Protection

What were the grounds under which such humanitarian protection was granted?
Do these grounds still apply?
What is the connection you have with Pakistan?
Do you have a national passport?

The ground which i was granted Humanitarian Protection on was that i would face persecution if returned back to pakistan, I was separated from my family in pakistan due to that. I dont currently have a Pakistani Passport but i can apply if necessary. I have family in Pakistan and i need to go to pakistan as it is a matter of urgency. The percecution elemant still applies.
thanks again

See Moderator CR001's replies and link above.

The guidance discusses whether or not you invalidate your protection.

If the persecution is by state-actors you would appear to be placing yourself in danger by travelling.
If persecution by non-state actors I suppose you will have to keep your head down.

Thanks for the reply Noajthan,
My case is based on non-state actors, I have one more question, if for instance, the worst case scenario they would not allow me back in the U.K, could I on the basis of that I am currently a second year university student and I also own property in the UK, Be able to gain entry back into the UK. And also after obtaining my national passport (which would be Pakistani) do I have to get a visa for Pakistan on that passport, what would the procedure be if you would kindly be able to tell me.
It would be appreciated greatly.
Thanks
Ahmed

If you have a valid national passport then you won't need a visa to enter Pakistan.

Owning property or being a student in UK doesn't give you any entry rights to UK.
Your entry rights depend on your current immigration status.

What travel documents do you have at the moment?

In what format is your hp?

Currently I have a piece of paper stating limited leave to remain, under humanitarian protection. I would need to apply for a Pakistani passport. The limited leave to remain document has a sticker on which it states the leave start and end date etc. If that's what you are asking for.
Thanks again

Does your leave to remain state any restrictions or did you get a letter stating any restrictions regarding traveling to home country?

How did you enter the UK?

Your appear to be 6 months away from ILR, I think it would be risky as your HP will be in question if you now feel it is ok to travel back home, where you 'claimed you would be persecuted'.

It doesn't say anything in particular about traveling to home country, I claimed asylum in the uk when I arrived here.
Thanks

HO takes a dim view of people 'returning' or 'holidaying' in the country that they fled from and have based their asylum claim in the UK on. It clearly shows that there likely isn't a real threat to you as previously claimed.

Your choice, your risk. Personally, I wouldn't do it, especially when so close to obtaining ILR.

Be aware the protection can be revoked (and any leave in UK can be curtailed) if the conditions no longer exist.
Similarly for any deception in originally filing the claim.
