ILR, Which Travel Document

Post by hikz » Tue Apr 26, 2016 6:01 pm

Hi All,

I hope you are all in the best of health and before posting my question I'd like to thank all of you especially the guys running this website for all the help and advice. I have been on this site for years and throughout my whole immigration process.

I was recognised as a refugee and give a 5 year leave to remain back in January 2011. I applied in December 2015 for my ILR, I was scared it would be refused as I had a few motoring offences mostly in 2012 and one in 2013. However, thank God I received my ILR a few days ago, on 22/04/2016.

I have a few questions that I'd appreciate it if someone can give me an answer to.

Firstly, will my offences affect my citizenship application as I was a bit confused due to people saying if you are to get punished for it, it would be an extension of leave instead of an ILR while others said it will be when you apply for your citizenship where you will get your application refused. So what is the right answer and I understand no one can give an accurate answer but just your thoughts based on experience.

Secondly, I heard people talking about a Life in The UK test, calling Citizen's Advice Bureau and even the council about the passport application etc... I came here very young and I studied at university here and I also work in the public sector! Would I have to do these things, and if I do can you please write down the steps for me?

Thirdly, I had a Blue Convention Travel Document which obviously expired with my leave. I now need to apply for a Travel Document. I am a Refugee, I am also stateless and now have an ILR!!! Which made things very confusing for me! Because in the TD112 it has 3 main sections for Stateless People, Refugees and ILR holders!! What category do I come under and does my ILR now cancel my Refugee Status?! I am planning to apply as soon as possible and I am actually very baffled and confused.

Finally, my leave expired in January 2016 and my ILR application was being processed. My Biometric and ILR grant letter was received in April 2016. Do I have to wait until January or April 2017 to apply for citizenship.

Thanks a lot for your help in advance guys and good luck to all of you.

Hi,

Your indefinite leave to remain probably states on your biometric resident that card that ' refugee settlement'. You continue to be a refugee until you obtain citizenship. Did you have the convention travel document blue? If yes, you can apply for another travel document and they will issue one to you just like before but this time, it would states you have no time limit on your stay in the UK.

In terms of your motoring offences, there is a possibility that it could affect your application for citizenship. Please read the Citizenship good character requirements : http://www.immigrationboards.com/britis ... 05532.html

In terms of the life in the UK test, it is a mandatory requirement if you want to obtain biritsh nationality . therefore, you would have to do it, but i would recommend you study before taking the test. I used the mobile phone app to prepare for it but some people might prefer using a book. Here is the link to book for the test :https://www.gov.uk/life-in-the-uk-test/ ... in-uk-test
You can only take the test an selected centre within a certain vicinity of your postcode.

In terms of when you can apply for nationality, you would have to wait 12 months after obtain your Settlement. therefore, you would have to wait till April 2017 ( the date when Indefinite leave was issues not when you applied for it).
