Is Tier 2 Cool off period applicable here?

Post by NKanthi87 » Tue May 17, 2016 9:32 am

Hi All,

I initially came to UK on Tier 2 Migrant (ICT Short term - Migrant) visa in Jan 2015 and went back to my home country, India in Nov 2015, at the end of my visa period.

Then, in March 2016, I travelled back to UK on Tier 2 Dependant ( ICT Long Term - Partner) visa.

Now, I am having a job offer from a company who is willing to sponsor me a Tier 2 General Visa.

Can I switch to General Visa right away? Is the cool off period applicable here? Please let me know.

Thanks!

12 months cooling off period applies from the date you left the UK in November 2015. You will only be eligible to apply for Tier 2 General from your home country in November 2016.

There is no cooling period for changing from Tier 2 ICT dependent visa to Tier 2 G, but you need to apply tier 2 g from our home country...

The cooling off period applies to the Tier 2 ICT Short Term period up and the OP will still have to wait 12 months from the date he left the UK, even as a PBS Dependent. The OP has not been a dependent throughout.
