Tier 2 General Job Code Clarification

Currently I am on a Tier 2 ICT dependent visa. I have a masters law degree from India and have worked as a legal consultant in different areas of law in my home country. One of the legal firms in UK is willing to offer me a job with sponsorship for a vacancy. But the job code for a legal professional 2419(Legal professionals not elsewhere classified) in codes of practice say these jobs require a qualified lawyer from UK. But there is one more job code 2423(Management consultants and business analysts) that can also be chosen with a job title as Business consultant that carries some of the skills of mine required to perform this job.

Though I can say a legal consultant is technically a business consultant in his field, Can the employer choose 2423(Management consultants and business analysts) when applying for COS and conduct RLMT?

What criteria Home office consider when approving a Tier 2 General? Is it experience or educational qualification? or it’s the discretion of the employer to fill a position if he thinks this candidate will be the best match for the role?

Please advise?

Hi Manci,
Its doesnt specifically say in codes of practice but looking at the job titles listed under the job code and speaking to some of the immigration advisors who didnt recommend using it so wanted a 2nd opinion. Please find the below job tiles mentioned for 2419. Can a legal graduate from other countries can use this to fill in jobs related to legal? we can use legal adviser or legal consultant but not sure how home office rules apply when applying for COS. Business consultant can also be used as per my understanding.

Based on the job description it is the sponsor's, not the migrant's, responsibility to decide what SOC code to use in the Cos. The HO generally only check if they think that that there is a mismatch and/or if they suspect that the migrant's background is not suitable for the job in question.
