FLR Application processing times

Post by ashleighhh » Fri May 20, 2016 3:29 pm

Hi all,

I've been a silent reader on this site for a few weeks now and I could really use some advice. I am an Australian who originally came to the UK on a Tier 5 Youth Mobility Visa. My partner has dual citizenship, Austrlian/British. I applied for FLR (O) and provided all documents needed. My time line is

Submitted docs - 08th March
Received biometric letter - 11th March
Submitted biometrics - 15th March

It is well over the 8 week period now and I have called at least 3 times a week in the last 3 weeks to see what I can do to get more information, however, all I have been told is 'nothing can be done, you just have to wait'. I can understand that there are a lot of cases Home Office are dealing with and I would not be so concerned, if it wasn't for our current tenancy ending in two weeks time. We obviously can not sign a new lease, nor do we know if we should without receiving our passports and visa to know that I can stay in the UK.

My previous visa expired on the 16th May and I was advised I was fine to stay in the UK until a decision was made, however, I have not received any letter or notification stating that there is a delay or when we can expect our documents back. I have run out of options, calling and writing does not seem to be getting me anywhere. Has anyone else been in this situation? Does anyone have any suggestions?

Thanks!

I'm sorry to say that you've applied for the wrong category of visa. If you were switching to Further Leave to Remain as a partner, you should have submitted a FLR(M) visa application.

I've moved your post to the Immigration for family members section of the forum.

Agree with Casa. You should have applied on FLR(M) and you could have applied in person for a same day decision.

p.s. you don't have to sign a new tenancy, it not a legal requirement to sign a new one each time. A lot of tenancies just roll over onto Periodic shorthold tenancy, i.e. month to month.
