hi
i was granted LOTR under article 8 (2) section 3.2.8 exceptional circumstance without public funding i ask for a re assessment and was granted public funding i am in temporary accommodation and now the council is telling me they cant house me under section 185 (1) of the housing act i am of jamaican nationality my children are british am i considered to be a person subject to immigration control

Yes until you have been granted Indefinite Leave to Remain (ILR) you are still considered to be under immigration control. You may be able to argue the fact that you have recourse to Public funds, but this is an issue you will need to take up with your local Housing Officer. You should bear in mind that in certain London boroughs there are reported to currently be 2,000 or more applicants waiting to be housed.

Edit: I missed digit in the 2,000. It should read 20,000 or more applicants. :|

Pls I am under the same circumstances with LOTR and I need to know pls (natnat), how you can apply for the reassessment you mentioned, I have heard something like that vaguely in the past and no one really told me how it works, I have claimed Child Tax credits which have now been stopped due to LOTR with no recourse, I heard someone was on the same thing but was allowed eventually to claim benefit since my kids are now 10 and 7 and I am planning on now applying for ILR as I now have more than the 120 months I must have lived in UK to qualify infact I now have 144 months in total, so pls any advice on how to go about reassessment for benefits esp for the sake of my kids, pls if you are in that situation or have been or knows someone who has been pls your advice would be beneficial.
