This would likely only be applicable if the OP had made use of the vast array of mental health services freely available on the NHS. I suspect in other countries, it is called something else though 'committed' maybe (in SA anyway).

Did you never seek medical help from your GP? This would be easier to prove than long distance telephone consultations as even phone records won't confirm what the conversations were related to.

This would carry more weight if coming from UK authorities;
also if the certification and treatment had been mentioned at the relevant time and not after the event.

So just mild depression then.

You should have gone to GP and been prescribed with mild anti-depressants, then there would be a proper trail.

I think you've weakened what what was already a weak case by not doing this.

I have a good friend who suffers from severe depression, and has been 'sectioned' ie incarcerated for his own safety three times, that's severe.

Not mild depression. I was going through a lot of emotional pain. I was extremely Sad and Hopeless about something in my personal life. I lost motivation to study at that time. I could Not concentrate on my study, that's why I could Not do any module and decided to withdraw myself. The mental health doctor (in my home country) knows me since a long time. And he has been very helpful as he is from the same culture, same language just like me, and I obviously would NOT feel comfortable talking about my inner feelings with the foreign people (NHS etc).
When I will go back to my home country, he can give me certificates stating that I was suffering emotionally that's why could Not study during MSc. And he can include how many sessions I have taken with him over the phone, etc etc.
Will it help me ?

To be my usual blunt self.... You are not going to beat the five year cap.
Any attempt to claw the lost months when you claimed to be be medically unfit to study is not going to be successful. No UK medical records .... No medical issue. End of.

Nothing that is produced other than from a UK recognised medical body with the appropriate specialism in the mental health field will be accepted as evidence. Long distance counciling is not going to cut it. And another issue, medical records from numerous countries are regarded as worthless regardless. Primary reason is the ease of paying for certificates that will say exactly what you want.... Happens in the UK with many private patients doing the same thing. No NHS or BUPA, AXA type organisation will issue bogus certificates hence they have substance.

No UK medical records, BUT there are records in my home country :| . And it's TRUE that I was suffering from severe emotional pain. Are you 100% sure that HO will refuse my medical certificates (which are from my home country) ? Is there any rule in the guidance regarding this? :|

Hi everyone, thanks a lot for helping me with my queries. I called HO but didn't get a proper answer regarding the issue below. Is there ANYONE who can address the following questions? please, its very veryy urgent..... Sorry :(

In the Tier 4 policy guidance for applicants, in page 30 (para 109) it says --
109. We will also count any previous periods of leave you have held under Tier 4 (General) and/or the Student route, where you have subsequently left the UK. This period will be counted from the date the leave began until the date it expired. If you extended your Tier 4/Student leave, or received any period of continuing leave in accordance with section 3c of the Immigration Act 1971, this will be included. If your leave was curtailed, we will take the date the curtailed leave expired.
Ques A) Will Home Office count the time UP TO the END of curtailment period (i.e. the date on which 60 days will be finished) within the 5 year CAP? i.e. Will HO count the "60 days" period within the CAP?

Ques B) If I leave UK 30 days before my "60 days" finishes, will the remaining 30 days be counted within the 5 year cap?

Yes they still count the curtailment period

If you leave the UK prior to the issue of your curtailment letter then you stock the 5 year clock

I believe that the total periods of leave granted, since the age of 18, under Tier 4 (General) or student, may be considered. A period of leave may be increased via Section 3C or decreased via curtailment. In the latter case, I don't see that your departure date would have an affect.

You do know without progression and your failure to complete your Masters this will almost certainly be the end of your UK education. Regardless of the 5 year cap.

Nothing is going to overcome the combined issues.

@darkcloud, you have now spent over a week now asking essentially the same questions.

That is one week you could have spent focusing on your Plan B.

Suggest look at the Netherlands for starters.
You can fly there easily by budget airline for under £50.

Almost everyone speaks English.
The Netherlands university system is world-class. There are bachelors and masters programmes taught in English.

Its very easy to get around the country by high-speed train.
Suggest check out some open days in a number of institutions.

But I am going to apply from my home country, so "progression" will NOT matter. And OBVIOUSLY I cannot go to upper level course without finishing my Masters first :(. I withdrew from Masters because of my severe emotional suffering. It can happen with anybody, we are Not perfect. Do all of these have anything to do with my "credibility" ?
What have I done "wrong" that my UK education will come to an end? :( :(
If any student withdraws from his course and wants to do the the same level course in a different uni, he has to apply from home country. So you mean, he will FAIL to enter the UK again and his UK education will come to an end? :shock: What is my chance of getting visa when I will apply from my home country for this September intake? what do u think?

I've stated your numerous issues, as have other moderators. It won't be us you need to convince - you will need to convince a Tier 4 Sponsor to issue you a CAS. I'd suggest that instead of spending weeks posting here asking the same questions, if you truly want to continue your studies after returning home, you speak to other Universities and lodge your enquiries with them. There's nothing more that can really be said in this topic I am afraid. The decision will rest with Tier 4 Sponsors and their admissions processes. We've all expressed our opinions and yet the same questions keep being asked - please, if you wish to try to continue your study in the UK journey, contact Universities and their Admissions lines.

There is not a university in the UK that will issue you with a CAS - as I have pointed out you are essentially a toxic student. You failed to pass your previous course and you have used up your 5,years cap.

What part of this are you failing to understand?

Nope, I want to know the answer which is Correct (even if it is negative). I am just shocked that someone's UK education will probably come to an end just because of Not finishing a course. It seems like it is a BIG Sin in the eyes of HO.

I am NOT considering my foundation course within the 5 year CAP.

5 year cap is ONLY for degree level studies right? If it is right then my 5 year Cap is NOT finished yet.

Could you plse tell me why did you say I have used up my 5 year cap?
