EEA Family Permit Advice

EEA Family Permit Advice

Hi There

I really hope someone may be able to give me some clear advice in regards to an EEA Family Permit.

I am a UK citizen, born to UK parents, I have been in a relationship with a Thai girl for the last 2 years and we have visited each other on numerous occasions.

We now have a 2 month old baby (born in Thailand) and I have just received confirmation that our application for the baby's British passport has been approved so I will have that passport within a few days so it is now urgent for me to get them both to the UK as soon as possible using the EEA Family Permit route.

Can someone please advise me as to whether we apply on the basis of her being the primary carer of the baby who is an EU national or do we apply based on her coming to live with her husband, I guess it would be great to know if we actually need an EEA Family Permit at all, I plan to go to Thailand to bring her and the baby back with me, could I just fly to the UK with her and the baby and get her through immigration.

We are officially married, all of her documents now carry my surname as do the baby's

I would be so grateful if someone can advise me as I am finding the process a little daunting, I would be happy to provide any further info if needed.

Where are you and where is family coming from (Europe or Thailand)?

As a Brit the EEA family permit is not an option that is normally open to you as UK gov does not consider you to be an EEA national.

That is unless you have enjoyed a sojourn in Europe (with family) under the Surinder Singh route.
Have you done that?
If you have not then its a case of applying for family settlement under UK immigration regulations.

Thanks for the quick response, I am in the UK and my wife and child are in Thailand, it sounds like the EEA permit is not the way to proceed for me, I have not had a sojourn in Europe.

knowing this can you confirm that it is a family settlement visa that I need to apply for?

I really appreciate your advice.

The UK route is more financially challenging and stringent in other requirements (compared to EU migration route).
SS is still an option if you all decide to take a detour via Europe.
