Tier 2 ICT to Tier 2 General to ILR (post Apr'10)

Hi Team,

You are really doing very good job.

Please guide me with My case, So that I can plan for visa switch.

I first came in UK on July 2010(6 April 2010 - 5 April 2011) on Tier 2 ICT, In another 1 month I will complete 6 year with the same visa extending(from uk) in the past years.

I do have few questions.

1. I have got sponsor to switch my visa type from T2 ICT to T2 General. Am I eligible to switch ?
2. How long, I can stay in UK(If I switch to T2 General) ?
3. Will I be eligible for ILR(If I switch to T2 General)? If yes then when? July 2020(10 years LR) ?

Yes

10 years by Long Residence - July 2020 (or) 5 years after you switch to Tier 2 General(Work Visa route)

Thanks for the response.
I have another question regarding "10 years by Long Residence". Suppose, If i continue to stay until July 2020.

1. How many days i can be out of the country per year? and in total in this 10/5 years?
2. Is this(absent) rule applied for all 10 years? or only last 5 years for PR.

I have a gap of for more than 6 months(Jan 2012 to July 2012).

Note:- I left the UK starting of Jan 2012 & returned to UK on end of July 2012. i.e. I came back to UK on the same visa(issued on June 2010) on July 2012.

Hence above question. Please guide.

For ILR based on 10 years long residence, your TOTAL absence for the whole 10 years cannot be more than 540 days and no single absence can be more than 180 days.

2. Is this(absent) rule applied for all 10 years? or only last 5 years for PR. PR is attained under the EU route. You are under the UK immigration route and it is ILR. See my answer in #1 above.

I have a gap of for more than 6 months(Jan 2012 to July 2012). Then you have a problem if you cannot split this into 2 separate 12 month periods. For long residence ILR, an absence of 180 days or more breaks your continuity in residence.

Note:- I left the UK starting of Jan 2012 & returned to UK on end of July 2012. i.e. I came back to UK on the same visa(issued on June 2010) on July 2012. See #1 and #2 answers above.
