10 year visa route and benefits

I'm British and my partner is indian on a 10year route family visa with no public funds. He has 2 and half year visa. We have a 10 month old son and my parter now is only working. I am claiming housing benefit as a joint claim with my partner (we are not married) as the second applicant. I put on the application he is subject to immigration control and our application had been accepted. Will that affect his future visa

You should check with the Housing Benefits office that only you and the children have been included in the calculation. You were correct to inform them that your husband has no recourse to Public funds.
Child tax credits should be claimed in joint names and child benefit in your name only.

They have used my partners salary in the calculations as I am now unemployed to work out how much I get.
Obviously I had to state his NI number.

As I said, check that you are only being awarded Housing benefit as a single person with children. In actual fact, the amount will probably be equal to that of a couple without children.

Not if you are able to confirm that the housing benefit awarded does not include your husband in the calculation.

Thanks. I have contacted my council and they said I have nothing to worry about as I made the claim and i am British. they have no interest on his status if he is entitled public funds or not as I am the one claiming. If my partner was the claimant then they will not issue HB as he is not entitled to. It only really affect people who claim job seekers.

Actually, if your husband has paid sufficient NI contributions he would be entitled to claim contribution-based jobseeker’s allowance as this isn't considered to be a Public fund, unlike income based JSA.

No, it affects a lot of benefits including the two benefits that the council (presently) manage, Housing Benefit and whatever Council Tax Benefit is now called.

The reason the Housing Benefit amount didn't affect you is because you have a child.

All situations and circumstances and different for every family. So it's best to just contact the office and query it.
