Daughter's Visa from India - Queries

Post by man0jshrma » Sun May 01, 2016 6:18 pm

Hi All,

My apologies if a similar question has already been asked before.

I am currently in UK with ILR. My wife has a Tier 1 dependent Visa (based on my Visa category before my ILR), which is going to expire in Oct, 2016.

We had a daughter in India on 16th Feb, 2016 and currently my daughter and my wife are in India and I would like to bring them to UK after the visa.

I have few queries based on the documentation for Join Family in UK Visa (https://www.gov.uk/join-family-in-uk).

1. Even though my wife's old Tier 1 dependent Visa is still valid till Oct 2016 but will it be better if she also apply for visa under the Join Family in UK visa along with our daughter's application.

2. This is related to Financial Maintenance requirement: I am currently employed in a permanent job where i have earned around 38K in the last 12 months as a salaried employ so there is no problem from the actual money earned requirements, but i have recently got a contract role and will soon be starting in this role with my own company.
So although I have earned the required money for the financial requirements from the salaried employee yet at the time of application i will not be in the role of the salaried employee so what all documents i need to provide to fulfill the requirements.

3. Just to confirm, I need to complete the following forms in addition to the online form on Visa4UK site:
https://www.gov.uk/government/uploads/s ... endix2.pdf

https://www.gov.uk/government/uploads/s ... /VAF4A.pdf

https://www.gov.uk/government/uploads/s ... p-form.pdf

It will be really if members from the forum can please provide some help/suggestions/pointers to me.

Thanks a lot in advance for all the help.

Assuming you were granted ILR under PBS route (not long residence):

Apply for entry clearance as PBS dependant.
Continue extending PBS dependant leave for both until wife qualifies for ILR.
Child qualifies for ILR with mother.

Make sure wife and child enter UK before wife's current PBS dependant leave expires, and apply for extension before expiry.
Life isn't fair, but you can be!

Yes that is correct, I was granted ILR under PBS route.

So, just to confirm, even though my current status is ILR settlement, my dependents can still continue to use the Tier 1 dependent route for getting entry clearance.

Also, as per my understanding then, my daughter will get her entry clearance till Oct 2016 as per her mother's entry clearance status and then i need to get their leave to remain extended before that expires.
Is this correct.

Thanks a lot.

Hi All,

I have another query related to the application for my daughter's Tier 1 dependent Visa.
I currently have PBD Settlement and my wife has Tier 1 general depenedent Visa valid till 24-10-2016.
My daughter was born in India in February.

I have submitted an online application for my daughter's Tier 1 dependent visa and have received an appointment in Delhi VFS centre to submit the documents for the application.

For the online application, the account had my details so when the application was submitted the generated form for print had my name in the 'Form Completed By' section but as the application need to be submitted by my wife for my daughter who is going to submit all the documents at VFS, so in this scenario can she sign the print form and submit it at VFS.

We have checked at VFS today and they said that my wife can submit the form and it is fine.

Please suggest if this is correct or we need to do something else.

Thanks a lot.

Manoj

Hi,

Can somebody please help me with this query.
Also, can someone please confirm if this query is not valid at this place then do i need to create a new post and delete this query here.

Because i did not receive any responses for this query due to that i have created a new post but it seems that post has been deleted by moderators or somebody as i cannot see that anymore.

Please advise.

Thanks a lot for all your help.
