Surinder Singh Route Post Renogtiation

Surinder Singh Route Post Renogtiation

Hi
I will be marrying my non-EU resident fiance in August of this year. I will also be starting a new job in Portugal in September so will be applying for my wife to join me in Portugal.

I will be coming back to the UK for family visits etc. My question is will my wife be able to accompany me to the UK using the Surinder Singh route with the renegotiated EU deal/potential Brexit?

Accompany to visit? - use Article 10 EU RC for entry to UK ( &/or FP).

or do you mean wife to accompany you on returning to UK for good? Noone knows.

Not for visits. The SS route is for re-settlement in the UK after exercising Treaty rights in another EU state. No one can predict with any certainty the future of Surinder Singh, only surmise.

It was for both instances as I won't be ruling out returning to the UK permanently.

I take it Article 10 that you have referred me to will still be valid following potential brexit/ renogotiated deal?

If I was to return permanently would there be scope under Surinder Singh Route?

Is my understanding thus far correct in that visits shouldn't be an issue but resettlement is whole different ball game?

Well noone knows on either point really - as we don't know the potential shape of Europe and UK's place in it after the referendum.

As things stand, wife could visit UK with you, brandishing her RC, (with a copy of Directive for backup) and possibly, to smooth the way, a UK-issued FP.

As things stand now, you could do the same after a sojourn in Europe on SS route.

True. But the issue is I don't start the job until September and then god knows how long it takes to get her a visa for Portugal. By then who knows what the European political landscape will look like.

The curtain won't come down immediately after an 'In' or 'Out' vote. The general consensus is that even after an 'Out' vote, it could take 2 years.
