help with british citizen and asylum

Hi all,

I am a British citizen and have been born and bred in the UK my entire life. My parents originate from Libya and live over there now. I married my husband 2 years ago in Libya and he has now came to the UK with me and applied for a asylum. His asylum was refused last year after giving birth to our first baby and now we have gone to court. It has been 3 weeks since our court appeal and we re waiting for the judges decision. How long does it usually take and what should i expect based on previous cases as I am very nervous.

His asylum was refused as the home office didn't take into account some evidence and believed that he was not in danger in Libya, they also said he doe not have a british child which was true at the time because they sent the refusal on the day I gave birth

The British embassy is closed in Libya and it is not safe for him to go back.

Just go told on the phone that the appeal was dismissed so I don't know what happens from there.

yes but he's away, I am also a student so I do not work either which is another problem

My daughter is 11 months old so I don know of he can apply and meet the eligibility criteria

Your lawyer needs to appeal to the (upper tribunal if it hasn't already been done) and you need to make sure that you work at-least part time and your husband wont be claiming benefits. If you are claiming already then there will be a problem unfortunately..

I do not claim any benefits, I am a student and I have been offered a job soon so might start to work in a few weeks. How long does the upper tribunal take?
I feel like my future has been ruined

Hi all,

I have posted here before about my husband having his asylum case dismissed by the first tier tribunal. Our solicitor believes that they best thing to do is to go through the further submissions route and prove to the home office that we are married and that we have a british child. Does anyone know if this route is successful or is appealing to the upper tribunal better? please advise me on this matter.

Submit documentary evidence of active parenting, involvement, decision making in the upbringing of the child. Father’s name must be on birth certificate. Documentary evidence of cohabiting.
