Hi

I recently got ILR visa now I need to apply visa for my wife and 2 kids.

Wife entered to UK as my dependant in 2008 Dec and she went back to our country in 2010 Dec to apply a student visa. She got the visa and entered in Jan 2011. Then she extended to PSW and next to Entrepreneur. Her current visa expires in Sep 2017. What application form she needs to apply?

Kid No1 was born in UK in 2009 and currently got a dependent visa of my wife. It expires in Sep 2017. Which application form for her?

Kid No2 also born here in 2015. No any visa applied, still 7 months. But we have his passport with us now. Which application form for him?

Please advice.

Both UK-born kids are entitled to register.

Wife's application depends on the category under which you were granted ILR.

If she's not a dependant, then it may be better for her to continue on her path.

Hi

Thank you for the reply,
But again My wife visa going to expire August 2017, at that time she just complete 8 years.
So I would like to change her statues as soon as possible. In her status she can't work.
Now she already complete 7 and half years stay in UK, can I apply now as SET (M) ?

No. SET(M) requires previous leave category to be that of the partner of a settled person.

Your spouse needs to complete form FLR(M). You need to meet the financial requirement and as your children are not British yet, this will likely be £24,800pa. She needs to meet the English requirement.

It would be worthwhile to register your UK born children as British first and then apply for the spouse visa as the financial requirement will be £18,600pa.

Dear CR001 and Vinny,

Thank you very much for your replies,

As you suggested I am filling in forms to register my both kids as British. I used Form MN1. Is that correct ? (They were born in 2009 and 2015)

I got LR under 10 year rule. I saw a recent changes in April 2016. So it is great if you could confirm me which application form I must fill in for my spouse? is it FLR(M) or FLR(FP) ? She holds an MSC from a UK uni so I believe no need to meet language requirement. Do I still need to meet financial requirement if the relevent form is FLR(FP) ? And how long will it get for settlement ? (Does she have to wait for another 5 years?)

Please help me to sort these things..Many thanks in advance.

If you meet the financial requirement it is form FLR(M) - a new 5 year route to ILR (or 10 years long residence which she should reach before that).

If you do not meet the financial requirement, then it is FLR(FP), which is a new 10 year route to ILR (or 10 years long residence which she should reach before that).

She will have to also pay the £500 immigration health surcharge.

I can meet the financial requirements so can apply FLR(M) for her as you've mentioned. Once got FLR(M) visa, in 2018 as she complete 10 years here, can she apply set(lr) in 2018 without waiting to complete 5 years of Flr(m) ?Is that the meaning you mentioned in braces below?

Yes, any legal visa status counts for ILR long residence.

I have one more thing to get clarified.
My younger kid is still 7 months and have applied citizenship from our high commission in London but it is still pending and they said it will take about an year to receive. So as I apply MN1 application next week do I need to mention it in there ?
We have only his passport in hand at the moment.

Your child is whatever nationality you are, he is not stateless and this is the nationality you state in MN1.

So not sure what you mean by 'apply for citizenship at high commission'. HO don't care, his current citizenship will be the same as yours.

Dear CR001,

Regarding MN1 Application of my baby

I have a big issue of finding a referee who has engaged in a professional capacity. Solicitor,My GP, Health Visitor all are not willing to sign. So one of my school friends who now is a BC and practice as a GP, signed for the professional referee 1, and stated as "father known about 20 years". Is it ok ???? Please reply

Hi

My wife going to apply FLR-M,
1. I would like to know money which I need to show with tax or without tax?
2.Last 12 month I worked 2 company so can I show my salary slip? (Because I didn't have pervious company P60)
3. I can fulfil £24800, so Do I need to wait until child get citizen certificate?
4. wife current visa exp. 09.2017 is it a issue she can apply FLR M now?
5. She got MSc in Middlesex university, is she still need complete English test ?

2. Fine and don't forget bank statements

3. No you can apply now if you meet the spouse+child financial requirement.

4. You can apply now.

Dear CR001,

Regarding the FLR(M) Financial Requirement

To specify gross annual income, I can only fulfill the requirement counting both (salary + over time) before tax from 2 employers. Without over time I am not able to fulfill the requirement of £24800.

1. Is it fine to show the financial requirement counting both salary + OT ?

2. How home office normally define "Annual Income" ??? If I provide immediate last 12 months salary slips + bank statements are enough ?

3. Do I need to provide a letter from employer? If I ask a letter, they will confirm only my annual package as the annual income and normally not mention the OT I earned. So is it must to provide a letter from employer?

Apply under Category A: With current employer for 6 months or more

Q1. My wages details as below.
2016 June -> Salary £1950 + OT £708 = Total £2658
2016 May -> Salary £1950 + OT £360 = Total £2310
2016 April -> Salary £1916 + OT £530 = Total £2446
2016 March -> Salary £1916 + OT £0 = Total £1916
2016 February -> Salary £1916 + OT £265 = Total £2181
2016 January -> Salary £1916 + OT £0 = Total £1916

All these figures are before tax. As we have 2 children it is required to show £24800.

Please advise Is financial requirement met to apply FLR-M ?

No it is not because HO will take the lowest figure (March 2016) to do the calculation.

Have you applied for BC for your kids yet? If they get British citizenship, then you only need to meet £18,600pa. Your wife still has a valid visa, you can delay her FLR(M) application for a bit.

Do you think It is worth applying FLR FP not waiting to receive BC of kids? OR wait and apply FLR M?

I would suggest wait for BC certs and then apply FLR(M), this is provided she has no travel plans as re-entering the UK on her current visa is risky.

Now we are planning to post my wife's FLR M application this week.

For financial documents, I submit my past 6 months (bank statements + Salary slips + contract of employment + annual salary increment letter in Apr 2016)

My question
Do I need to submit an employment confirmation letter from my company in addition to above documents?

FLR M Question 2.3
I am not sure how to fill it, this is my 1 st FLR M application, I apply this as my husband recently got the settlement visa. May current visa is entrepreneur.
Do I need to tick the "First Period of leave to remain" or do I need to use the given box to explain on page 12 ?
