Help please - Tier 2 dependent visa extension

Post by Mehreen » Sat Jun 18, 2016 5:58 pm

Hi everyone.

Can someone please advise me on the following?

I am on a Tier-2 dependent visa since May 2013 and my husband got his ILR last year. He was in a job till then and now he started his own business. He owns a ltd company now. I am due for my visa extension in October this year.

Can someone please tell me what documents do i need to show for my application. Does my husband need to show his income as well? What is the minimum he should be earning to support my visa? We do have the maintenance requirements in our accounts(£945+£630)

Also our baby girl is on a dependant visa as well but since she was born in the UK we will apply for her British passport instead of going for the visa gain and spending a fortune! What documents do we need to show for her? Again do we need to show my husbands earnings etc?

PLEASE HELP!

Did your husband get ILR based on Tier 2 or based on 10 years long residence?

For the child citizenship questions, please post the queries in the sub forum linked below.

Also I wanted to ask how soon can i apply for my visa extension? I mean what is the earliest I can apply? Can I apply now? I am going to India for 2 months and will have to apply just when I am back so it would be stressful then getting all the bills and everything as we are planning to move flats here in the UK

It is not necessary to tag your question onto other members old posts. It is a weekend, we also have family and other commitments.

Thanks for your response.

I understand you have commitments and it is the weekend but I thought the forum is here to help one in need. For me this weekend is the most stressful one because of all this.
I expect people who are willing to help answer. I am not forcing anyone.

Obviously I have gone through all these links already but none answers my question.

The point of the forum is to get help from people who have gone through the same process at some point in their lives! That just gives assurance. Why do you think people would jump on the forum without going through the UKBA website itself first!

And re: tagging other posts- the posts have had similar problems to me and its regarding whether my husband needs to show any payslips if he owns a ltd company etc and whether I could skip showing his income etc- So again my point is if you don't want to answer that's absolutely fine- but don't consider someone's misery being someone's laziness!

I did not say or assume your were 'lazy'. The forum is full of posts that could answer your questions, as does the guidance notes.

The point is, members offer their time for free, if and when they wish to respond to a post. Posting your question multiple times is against forum T & C's. If you feel you are not getting the immediate attention and response you wish, you could of course consult an OISC advisor and pay the fee for urgent advice. Given that your visa only expires in October, there doesn't appear to be an 'urgent, right now' type of scenario.

If you have in fact read the HO/UKVI (UKBA no longer exists) documents, you will have seen that there is no 'minimum income' requirement (as per spouse settlement visa) to extend Tie 2 G Dep and only the maintenance requirement.

You also need proof of subsisting marriage with 2 years proof of cohabitation.

Thank you again.

Can you please send a link where it says that? I cant' find one. I know I have said it's not urgent but I haven't given a detailed description of what else is going on. My husband's limited company isn't earning enough to support my visa requirements so if we had to show the payslips I would be worried right now.

I am sorry if out of frustration I said anything not pleasing but I want to apply for the visa right now even if there are 4 months till my visa expires. Is this too early? I mean is it possible at all?

I would be really grateful if you could help me out on this.

Yes, I know that. The 'minimum income' requirement is for a spouse visa (used as an example in my statement below), so is not applicable to you.
there is no 'minimum income' requirement (as per spouse settlement visa) to extend Tie 2 G dep
You will also have to pay the immigration health surcharge of £600 for your extension which will likely be issued for 3 years. You can extend at any point.

When do you plan on applying MN1 for your UK born child? I am not sure if the maintenance requirement will have to include the amount for the child as the child is still a 'dependent' and not BC as yet.

No, it is not a link. I was merely highlighting that I know you are not on a spouse visa as I used it only as an example where there is a 'income requirement'.
