Parents Visit Visa Refused and MP Letter

Post by monty87 » Tue Jun 21, 2016 8:33 pm

Hi guys,

I have recently been rejected my parents Visit visa today. We applied for 5 years multiple entry and ECO refused it saying that you have previously applied for settlement as an elderly dependent on child (British) which had been refused in 2014 and you will not come back.

I have submitted sponsor declaration letter and confirming they will go back and I am responsible for their return. ECO is satisfied with parents financially. I have shown my fathers residential and commercial properties and pension as ties. My parents have been visiting kids and grand kids for last 10 years and returning on time. They have now refused just because we applied for parents elderly dependent in 2014 which had been refused due to lack of medical evidence earlier in 2014.

I am thinking of writing a complaint letter to High commission of Pakistan, Islamabad and a reference letter from Mayor of London. I am British for last 13 years and parents have been visiting us for last 10 years and never overstayed.

Do you guys have any similar experience? Do you have any suggestions?

Please let me know.

Regrettably, a failed adult dependent application triggers a refusal as visitors due to the prior intention to settle.

Thanks for your reply.
How can I overcome this? Even though I have given my declaration and taken responsibility they will go back.

I'm sorry to say that I don't believe you will be able to overcome it. There is no appeal for visitor visa application refusals, only a Judicial Review through the Court or a claim under Human Rights. Your assurances that your parents will return without overstaying, won't bear any weight.
When members post on the forum that they are considering an Adult Dependent application, moderators and senior members always warn of the consequences in relation to future visits if the application is refused.
You may find this article by Free Movement informative:

Edit: Note in the article " if visits can be conducted in another country then human rights are supposedly not engaged."
