PR card - how best to evidence exercising treaty rights

Hello. What a great forum of resources. Anyone able to steer me on a couple of questions please?

After this weeks events we've decided to spend some of our savings on obtaining dual British-Danish Citizenship for my wife. Step 1 I believe is a PR card.

Been reading for the last 8 hours straight; and figured out that our document retention is poor

Q: Because we're fortunate to have CSI I think we can evidence self sufficiency throughout - does that negate the need to show employment? Or does it "infil" around the periods of employment we can evidence?

Q: If we struggle with P60s, can I get/use a letter of employment history from the tax office?


Background
  • - Danish citizen has been living in the UK for 8 years
    - Married to a UK Citizen
    - Plenty of paperwork to show her UK residency over the last 5 years
    - She's been included on a private healthcare policy throughout
    - We've held joint back accounts throughout with regular income
    - She's had an NI number throughout
    - She's been on the electoral role throughout

    But

    - She has been employed on and off - not continuously, and with different employers. Haven't retained P60s. One is a big enough firm so trying to track down some :(
    - She's had fair bit of time unemployed whilst raising our kids
    - She has a period of maternity, not employed, but taking SMP - not sure if this counts
    - In the last 12 months she has been self employed. No accountant. Think we have "some" of the SE documents asked for. Have read on here difficulty people have had with SE evidence.

Suggest apply for confirmation of PR on basis of self-sufficiency as you had the foresight to put CSI or similar in place.

(It would be very fiddly to collate all evidence for a little bit of employment in 20xx then maternity leave in 20xx then another job or a gap in 20xx & etc etc).

As soon as wife has DCPR she can shoot for the privilege of citizenship - assuming all other requirements have been/can be met;
ie no need to be free from immigration time restrictions for 12 months (by virtue of being the spouse of a BC).

Back again, hopefully someone kind enough to help.

The EEA (PR) asks me to document activity since my wife entered he UK

She's has CSI for the last 9 years, but she's been here 12.

Not to mention we can't get bank statements back that far.

Do I record just the last qualifying 5 years?

Or, do I record self sufficient for the whole 10 and only supply evidence for the 5?

Cover as much as you can.
And submit as much supporting documentary evidence as you can:
  • identity;
    residence;
    treaty rights (with CSI);
    absences within limits;
etc.

Don't take anything for granted, HO tends to play hard ball and not to give benefit of doubt.
