Hi,

Looking for some help with the £18,600 requirement

I've taken out in salary £8,064 gross
In dividend £8,486 net

the total net for the two from payslips/dividends etc is £16,549.42

When looking do they consider the Net of what an normal UK salary would be or the gross on the dividends (i.e. +10%). If it's the latter I won't be able to make the requirement. If it's the former I will. The guidence isn't particulalrly clear. I rang them today and they seemd a bit unsure themselves!

I have paid of my mortgage, the ironic part is if I still had a Mortgage i'd have the required savings. It almost sounds as if i'm peanlised for owning my own home and being a director.

Switch to spouse visa from student visa

Hello,

Just wondering if someone can help.

My girlfriend and I met only a couple of months ago and we fell madly in love with each other. I've looked into all the requirements financially etc and we tick all the boxes. The issue is she's here from Russia on a student visa that expires in August. Obviously we could get married which will take 30 days roughly but I'm wondering with the timeframes of us being together if this can work? Failing that she'll have to apply for a fiance visa from Russia which seems crazy with her being here already. Especially since a fiance visa can be granted to someone whose never met!

So to recap we want to switch from a student visa to a spouse visa, we've not been together very long. She's well settled in the UK, we live together at my house. She has until August left on her student visa.

Appreciate any advice that can be offered.

1. If you choose to marry in the UK you should be aware of the procedure as your fiance is a foreign national. You will have to register your intent to marry with a Home Office designated Registry Office. The Registrar is then legally bound to notify the HO who can then extend the notification period from 28 to 70 days in order to interview you both before the wedding can take place, should they choose to do so.
2. You may have left it too late to marry before the student visa expires.
3. As a matter of interest, a fiance visa will only be granted when the couple have met face-to-face.
(Casa, not CR001)

You have to give 28 days notice at an HO approved registery. They are obliged to inform HO of the marriage request of a foreign national and the notice period can and likely will be extended to 70 days for HO to investigate and interview each of you separately. This will happen before you are given permission (or not) to marry. Given that her visa expires soon, you likely won't get approval to marry and don't have enough time.

Failing that she'll have to apply for a fiance visa from Russia which seems crazy with her being here already. Especially since a fiance visa can be granted to someone whose never met! Uh no, one of the requirements of a fiance visa is that you have met.

So to recap we want to switch from a student visa to a spouse visa, we've not been together very long. She's well settled in the UK, we live together at my house. She has until August left on her student visa. Yes, technically she can switch to a spouse visa (once you are married) from a student visa, but see my point above.

Could she be using you as a visa mule? From a second world country, visa expiring, short term relationship - you never know.....
