Dependent Visa for PR holder

Hi All,

My brother got PR recently and he is interested in marrying a Pakistani origin girl who used to be a student but didn't extend her visa. She is an overstayer at the moment.

Can they do an Islamic marriage and go for PR-dependent visa? If they can't do an Islamic marriage then what is required from their side and how can he make that girl his dependent?

He is living in uk. He was married to a European national but got divorced last year. Applied for PR based on marriage and got it recently. The girl is also in UK but an overstayed Student.

I have moved your topic to this 'immigration for family members' sub forum as posting in the Europe forum was not the right place.

An Islamic marriage conducted in the UK will NOT be recognised in the UK or by HO.

In order to get married, they have to give 28 days notice to an HO approved Registry Office. Registry Office has to then inform HO that a non-EU person wishes to get married and this notice period can be extended to 70 days for HO to investigate and interview them separately.

Given that she has no valid leave in the UK, it is unlikely that they will be granted permission to marry and she will likely be detained, asked to report or deported.

There is no 'PR dependent' visa. It is a spouse settlement visa which costs £811 for a postal application plus an extra £500 immigration health surcharge.

Does your brother earn at least £18,600pa?

He does earn £18600+.

Would she get visa from back home if she voluntarily departs, get married in PK and apply spouse visa from there?
