ESA PIP housing

persons who takeing ESA suport group if change address
due to landlord evict notice, so in new house will
esa be effected or will be paid on the same rate.
pip was accpeted for 5 years so i know this will not
be a problem, and i takeing rent from coucil even after
leave the old house so will this be a problem for me
because in new house my claim yet is under process
for benifits of housing on other brough.

Moving areas does not change your benefit rates for PIP and ESA, but you MUST tell those benefits agenecies that you have moved and give them your new address. You are required to report all changes to them.

You must not take benefits for a house you no longer live in as that is benefit fraud. Your benefit letter from the previous council told you that you MUST report changes to them. Tell them you have moved out of that property and give them the correct date that you moved. The same with Council Tax.

The new council will backdate your HB to when you first claimed for that new house.
Your new landlord will know you are on benefits and therefore will know he has to wait for the rent as HB is paid in arrears.

yes i have been told them in 2 weeks through email
and got a auto reply that we will answer you
within 24 hours but its 48 hours gone, well the esa
and pip i have received in my bank. my new council
also did not reply me for new claim of housing or
benifits its about 10 days gone that i was applied it.

Did you provide the HB department with your eviction notice?

Were you evicted by the court/bailiffs?

What exactly did your landlord give as eviction notice?

i dont get ur menaing in HB,
eveicit notice the landlandy provided me
without court or lawer, it was just by her
self, my housing appeal is also with my previous
croydon that was the also reason i did not
tell them to stop my rent that time but
because now i have been told them and yet
i did not recieve any reply,

You can only be evicted by a court. A landlord cannot just 'evict' you, that would be illegal.

Did your landlord give you a Section 21 Eviction notice or a Section 8 Eviction notice? Or was it just a simple 'letter'?

What was the reason for eviction (if any)?

Is or was your deposit protected in one of the 3 government deposit protection schemes?

You should have contacted the council as soon as you got whatever it is your landlord gave you as 'eviction notice'. They would have offered you very good advice on what to do and the steps that happen before you have to leave a property.

I really hope that you were illegally evicted.

You have to inform HB that you are no longer in the property and your HB for that property must be stopped otherwise you will end up having to pay it all back.

thank u of ur reply

no depostie was made
went to council they said verbal notice
is enough so because i had not proof so
thats why asked landlady to provide me
written proof, so she made own evict notice
council did not help in croydon, but my
housing application was refused so i appealed
and provided that notice in appeal, she did
not make any reason to evict house but
i just told to council that contract finished in
my appeal application.

You can ONLY be evicted through the court after being issued a Section 21 or a Section 8 eviction notice. A contract/tenancy ending is not enough to end the tenancy.

What exactly did the 'eviction notice' say?

i am new house
evict notice nothing telling some thing
just a formal letter no reason in it,
i have changed my council and applied new
claim but my appeal is with old council,
the bew claim is with new housing i was
applied before 10 days but no reply yet
by them. i am worried that what will be
done with all of this. appeal new claim etc

appeal is not for old prpoerty but i was
eligible for a house by my old council so appeal
is for that they will hv to provide me a house i only
left council that i don't hv place to live.

If your landlord and you, had followed the proper eviction process, the council would have housed you once the court evicted you.

Actually you've assumed wrong. CR001 has probably the most experience on the forum on the law regarding tenants' rights & rented property. Without a court issued eviction notice, the local authority have no obligation to house you.

I have been through a lengthy eviction process myself and have studied landlord/tenant law.

Won't offer anymore posts or advice, the council should be able to resolve your issues.
