i am writing in connection to a friend's cousin.
the girl in question came to UK when she was 9yrs old and she is now 17years old.she came here as a visitor with her daddy but her dad left her with her uncle,who promised to bring back to their home country when he is coming,but unfortunately her daddy died immediately he got back to their home country which left her uncle with no other option than to look after the young girl due to the fact that her mum were no where to be found.Now the girl lives her entire duration in UK as over stayer.what can the uncle do to regularized the girl status in UK.the uncle is British with four children,all British.The girl is about to finish college but would not be able to go uni if her status is not sorted out.My questions
1]how can she regularize her paper
2]can we do it without going through solicitors,as they charge the uncle £4000 to help them
3]What kind of Application will she go for
i really believe in this forum that is why i am writing the story on here,please kindly advise and share you experience as the girl always live as a sad orphan.

She needs to get an application in before she reaches 18 based on a child staying in the UK for the last 7 years. Yes you can do it without a solicitor.
Even if she is aged 18 at the time of application she should also be allowed leave to remain as she will have been in the UK half of her life.
Paragraph 276ADE of the Rules indicates that leave to remain may be granted to a long residence
applicant if he or she has lived continuously in the UK:
for at least 20 years; or
for at least 7 years (and the applicant is under 18 years of age); or
for at least half of his life (and the applicant is aged between 18 and 25 years); or
for less than 20 years (and the applicant has no ties to the country to which he or she would
have to go if required to leave the UK).
Application flr(o) - 10 year route to settlement.

what are the document she will need for the application and what are the immigration rule we have to satisfied when apply?

Evidence to support that she has been in the UK 7 or more years. This should be easily done with evidence from schools, a letter from them confirming she has been studying at the school since xx date. Get the application in ASAP.

do we need to establish a compassionate ground showing why she cannot go back to her home country,maybe by putting her dad death certificate?
do we need financial status of her uncle too like bank account and proof of income? thanks Amber you are genius

She has to shown she has been in the UK 7 years, there is no financial requirement. Include the death certificate and any other supporting evidence.

Sorry, I got my wires crossed with another thread where the applicant is from Pakistan. The leave to remain will be issued by BRP rather than a vignette in the passport so that should be fine.

she had flr based on the 7 years rules in almost 3years ago and now she needs to renew the flr as she is now 21years.
MY QUESTIONS
1. What form is she going to fill
2. what are the requirements in terms of documents
3. how do go about it.
i need quick responses plzzzzz
