Asylum Seeker Marriage Requirements.

Hi there,

I am a sri lankan Nationality, i Claimed asylum(UK) on 2012 august. my claim was rejected on 2015 and then my appeal hear was adjourned twice in 2015. then my case was happened on 2016 june. Still i am waiting for case decision.

In between these my parents arranged a wedding proposal. Both side parents are happy. girl and me also happy about the decision. so when i call for registration office they requested COA ( Certified of approval) of my passport copy. So i send a letter to request to home office.

Now my worry is how long will take to home office send my COA and is it affect my case decision.

Please Help me with you advises.

Really very sorry about my poor English skill. hope every can understand my issue with my basic english description.

Please advice me. waiting for reply from members.

There is no COA anymore.

You now have to give 28 days notice at an HO approved Registry Office. They then have to inform HO that a non EU wishes to marry. The notice period can then be extended to 70 days for HO to investigate and interview both of you separately. If you don't have your passport, you cannot give notice.

If HO are happy, you can get married. If HO are not happy, then expect a problem. Given your circumstances you explained, you might not be granted permission to marry as HO will likely conclude that you are trying to find any means to remain in the UK.

Is that mean asylum seeker can't marry in UK.

My passport with HO. Then how can i give notice to registration office.

Is there anyway to get HO approved passport copy document to submit Registration office.

if it's what are the process for it.

is that mean we need to live together 28 days before registration.?

or is that mean she need to stay in UK for 28 days.

You've misunderstood. CR001 hasn't said you need to live together for 28 days.
The standard registration (waiting) period for marriage in the UK (for everyone) is 28 days. However, for all foreign nationals the Registrar will be unable to perform the marriage until permission has been given by the Home Office. The extended period of 70 days gives the Home Office time to interview you both (separately) before the wedding can take place. If they believe the marriage is a sham they can refuse you permission to marry.
Is your intended bride not living in the UK?

Yeah she is in Netherlands. She will be here once i invite her to London. She living with his parents.

can you advice what i need to do marry her. if you can please step by step.

Is she an EU national? Have you met in person?

I don't have passport with me, this is an arranged marriage by parents.
yes she is an EU national. She born there. her parents from Sri lanka.
we both speaking in phone and skype for last 2 months.
Now she and me ready to marry.
so what i need to do. please explain.

UKBA has not existed since 2013. It is Home Office (HO).

I am not familiar with the document you mention.

You will have a problem registering to marry without proper photographic ID and proof of your right to remain in the UK.

You'll also have a difficulty in convincing the Home Office that your marriage to someone you've never met, who is conveniently an EU national, that this hasn't been arranged in order to obtain the right to remain in the UK. The chance of being given permission to marry is unlikely and even more so as your intended wife is only coming to the UK to marry.
Also, you won't be able to register to marry without a passport.
