Adult child of UK citizen living in the US

Post by speearep » Thu Aug 04, 2016 10:26 pm

So after a recent trip back to the UK to visit family my adult daughter (23) has decided she would like to move to England and spend time with family. I have looked at the government site for immigration and found it to be confusing. My question in simple terms is can she apply for UK citizenship and what form.
I am a uk citizen living in the USA and hold a UK passport. Her mother is American.

Daughter born where?
when (1993/4)?

Parents married at DoB?

Are you BC other than by descent or BC
by descent?
Date of naturalisation (if naturalised)?

My daughter was born in Seattle USA in 1993.
I married her mother in 1991.

Daughter has smashed it! - she is BC by descent then.

Shoot for passport.
Should take approx 6-8 weeks.

looking at the passport application it asks if she was a British National at birth, as she was born in the US and has a US birth certificate does she have to apply for citizenship or just select yes on the passport App?

I don't have copy of or access to form.

However, as already stated, daughter is British.
If she needed to register as a citizen I would have advised accordingly.

She was British at birth. Read the guidance, it tells you exactly what is required. As she is a British citizen by descent, she will need to provide details of parents AND grandparents in order for HMPO to verify that she is British by descent.

If/when she gets round to having children of her own, birth in the UK will make life easier for later generations.

Unless a Crown Servant a BC by descent cannot pass on BC to children born abroad, but their UK born child is him/herself BC other than by descent - which restarts the cycle.

Your daughter cannot become a BC other than by descent (to put her in the same position as you) as there is no "upgrade path" from BC by descent.
