Divorce for Tier2 dependent

Post by Hasan12345 » Wed Aug 10, 2016 2:19 pm

Hi All,
I hope someone would be able to help me.
I'm currently on Tier2 visa. I called my wife as dependent on this visa but things haven't gone well and we have decided to part ways. She has already left UK.
As I'm not a UK national and and our marriage was held in India. I used the Nikkah Nama from India for sponsoring. I wanted to know if I need to obtain any legal documentation etc from UK for future? in case if I marry again in India and have to sponsor my 2nd wife?
BR,
Hasan

You need to inform HO about the marriage breakdown.

https://www.gov.uk/government/publicati ... nsent-form

You will need a valid divorce certificate before you can marry and bring another spouse.

Thanks a lot for your reply.
When you say 'valid divorce certificate' what would that document be exactly? Would it be something from UK or India?

Hasan

I am not familiar with Indian divorce stuff, but you are domiciled in the UK and can do a UK divorce which you will need her signature for.

Can you please advise what do you mean by domiciled in the UK? Is a person on Tier 2 domiciled in the UK? and would UK divorce proceedings (nisi/absolute) applicable/necessary to him for future marriage?

Hasan

Domiciled definition, a place of residence; abode; house or home.

Thanks so much for your reply. So, then as I'm on Tier2 and currently residing in UK, then with above definition, I'm domiciled in UK.
Then, the second part of my question stays, would a tier2-uk-domiciled person require divorce decree from UK? or is it only for UK national?

Anyone living in the UK can divorce through the UK courts.
