Help needed .. EEA residence card..Marriage

Hello guys!

Im living in the UK for almost 8 years.. Came here on student visa, moved to Tier 1 Entrepreneur. Getting a Tier 1 Entrepreneur was a pain in a back side but I finally got it.
My Tier 1 is due to expire in third week of october. I run a real estate investment consultancy and have got all the legal documents to extende my visa i.e created employment for 2 EU nationals and invested 50K.

Recently my bf proposed and we are planning to get married in Sep.

Now my questions is

a) Giving notice for marriage and getting married.

I dont mind getting married next year properly but I'm thinking of doing the paper work this year as it will be cheaper for me to apply for EEA residence card than paying a big solictor fee ( 4000 gbp) for Tier 1 Entrepreneur extention and the 1300 gbp for the visa fee as apposed to 65 gbp.

Me and my partner are living together and thinking of giving the notice in by the end of august. My visa is due to be extended third week of oct. How likely is that I'll get the green signal ? I heard the notice is displayed for 28 days and if any of the party is on visa then notice gets extended for 70 days!

I know there are a lot of sham marriages but a lot of genuine people suffer as well.

Any advice on this ?

b) To avoid this hassle I'm thinking if its better to go to New York with my friends and bf, and get married there ?

c) Regarding the application.. I have read the form, its not rocket science...

Can anyone share some positive stories please? Timelines from date of application to COA to arrival of visa...

RC is optional so you can save yourself 65 quids.
Move away from a 'visa' mindset if triggering EU migration trajectory.

Read timeline thread, its all in there.
Your mileage may vary ofcourse.

Don't take application for granted; rock-solid evidence required.
Get it wrong and risk turning yourself into an overstayer.

RC is a purely confirmatory document.
Useful but not compulsory. Its not a visa.

Get married before current leave expires.

I assume fiance is a Union citizen...
Make sure hubby knuckles down and is exercising treaty rights in UK as a qualified person.
The full power and weight of EU law will kick in to give you the right to reside, work and study.
Although in a migration context what you actually do is immaterial (as long as legal ofcourse).

You may find you start to develop cravings for cappuccino, croissants and Swiss or Belgian chocolates.

Do I have sufficient time for the go ahead from UKBA ?

He has been living here for more than 10 years, working as a professor in a college. Infact we are thinking he should apply for his PR as well. He is hungarian.

I'm a legal resident of the UK and can extend my stay even without EEA RC. I was just thinking of it as a more economical was, as visa fees and solicitor fees has soared in last few years .

Its UKVI now. (UKBA was abolished in 2013).

You may have left the timing a bit late to marry in UK. Just in time management I guess.

If you jump ship from UK Regs to EEA Regs you need to get it right. Or you risk falling between rock and hard place.

Get married before current leave expires. Then EU rights should kick in immediately, if, as you say, hubby to be is a worker.
You could always go and marry in Vegas.

Yes, anyone in UK on EU route would be wise to procure some EU-related documentaion to help secure their position with all this wild talk of Brexit.
Transitional arrangements made previously have typically depended on possession of a RC by a certain key date (all yet TBC for Brexit ofcourse).
You may have to rely on them too as newcomers to EU route are unlikely to acquire PR in the normal way anymore; (no time left).

Let's hope all goes well. Any other suggestions ? I actually wanted to do a ceremony here because all of my friends are here.. and its a special day for me so want all my loved ones to be around.
But sadly I cant expect all of my mates to just drop their plans and come to LV to my wedding.

Suggest just follow UK Registrar's website if marrying in UK. But timing will be tight and little or no contingency.

If abroad, procedure will be country-specific;
just bring back several official copies of marriage certificate (preferably in English); not just one copy.

I think they speak English if that's what you mean.

You will have to check their timelines for marriage notification, license & etc.

No.. I meant they issue marrige certificates in English and their civil partnership/ marriage certificate is valid all over the world.

Checked their notice period and everything. Gibraltar is the Las Vegas of europe lol

Rock-solid (if not unimpeachable) documentary supporting evidence is a must.
Don't take anything for granted, you will not be given benefit of doubt and 'rubber-stamped' through.
