EU family permit after refused asylum from uk

i have been refused asylum in uk while i was on visit visa in the uk and i had right of appeal from out side the uk after refused asylum. i decided to leave the uk and bought my own ticket and home office provided me a letter with one year ban. i was made a appeal from out side the uk and its going on and also has been refused in ftt. so now i want to apply family permit. its 18 month gone that i am out side the uk and i want to know as dependent can i apply eeu family permit on the base of a brother's sponsor? is eu regulation will not matter for any ban against uk immigration rules ? i have not any criminal record in uk. will i have right of appeal if i will be refused for family permit. i have only adverse immigration overstaying history and because a letter was provieded me so i think this time they will not have to make any excuse, also that eu regulaion laws are diffrent than uk immigration laws. please some one advise me that what is best for me. thank u

If you meet the requirements for a FP (proof of dependency etc etc) then you can only be refused on the basis of public policy, public safety or public health grounds.

i ubderstand your meaning public heath security
but in kind family terms i think i will have some benifits in courts during appeal because its confirm that family permit will be refused so easily but there is appeal after refusal as i studied. the most confusing question am i depedent enough
through transfer of money on every month base? i am living with parents and other extended family. so any idea? i am greatful that u replied actully with home office policy. still waiting ur answer relating to this. the thing is i have been seen home office diffrent links but i am in confusion because some one told me over internet that money transfer will not base as dependent also because other family also living with u. but i dont agree with this. what is ur opnion ?

You haven't provided enough information on your case for anyone to really understand or comment on.

Its not clear if you have applied and ben refused or oing to apply and expect to be refused.
FP does not come with automatic appeal rights; it depends on the reason for refusal (as another concurrent case shows).

soponsor is brother eu national qulified person in uk
transfers money
i m dependenr on him through his money
i want to apply family permit. so is it enough to show to eco for family permit that i m dependent in eu national
or i will hv to show other evidences? what they are? thank u

HO plays hard ball in these kinds of applications. You need rock-solid evidence to build your case.

Start with guidance on EFM as that's what you will be assessed against.Have you read it?
Ref Gov UK website for a start.

you r right m. i am reading it and doing nothing.
the thing is not very clear on there links on diffrent site almist every site i have been gone through. they just asking dependent
proof of a eu national. so in my mind money transfer is best than some thing else. there is nothing they have said if u living withh other reltives than u wouldnt be considered as extended family memeber is dependent on eu national. so a lawer told me that they will not consider only fund transfer u eill have to show u r disable with helo and support is not available in country where u living. but i think lawyer said is regarding immigration laws not with eu regulations. so thing has make my mind uo set because i was makeing proofs of dependency with money transfer every month. please ask to some one for me because reading on websites not clrealy answer. after lawyer coonsulation i have confusion. thanks anyway

ur provided link is very good but i have read it 100 time,
the outcome which comes for me from this link is that,,,,
 A relative of an EEA national or their spouse or civil partner who is dependent on the EEA national or is a member of their household, and:
o is accompanying the EEA national to the UK or wishes to join them, or
o has joined them in the UK and continues to be dependent on them or to be a
member of their household.
so what i can take a answer from all of this i know i am relate to only that
 A relative of an EEA national or their spouse or civil partner who is dependent on the EEA national or is a member of their household, and: so can guess what is there mean on depednet where this can be seen what is home office actually meaning.

I have patience to read posts; other members may not so you risk not getting the benefit of wider responses.

So that's probably as good as it gets in UK law.

The only other source you have is the EU law (Directive) and relevant case law. You will need this to fight your corner if/when refused.

Even today another member posted about a FP refusal; refusal for a mother - which is a stronger relationship (FM) than brother (EFM) in context of EU law and migration.

great to know, every one has diffrent stage, while home office was removing me a girl who she provided me letter with one year ban told me that out side the office people will tell u number of things that u wouldnt be able to return even in uk but do not get them in ur mind. apply after one
year accrodance with law. so ots up to the case worker some time they help u even they refuse u but sone time they refuse with a refusal which hasnt any cure. so i believe i will have a postive outcome even i will apply with less papers but my wording always made them inpressive, my asylum appeal is also under diffrent stages yet and in previous decision judge did not allow it but he findings were regarding in favour of me that even i can still visit to sblings in uk after all of this and nothing can prevent u in this . so a strange answer in asylum refusal from out side the uk. please be aware i have been in uk on number of times and i won appeals without lawyer but this time rules are not in favour of me so i am just looking a application which provided appeal after refusal. i hope i will reply u updates . have good time
