Dear moderators,

I'd be so grateful if you could help with the following.

I am applying for ILR this month after being on tier 2 general for 5 years.

My wife came as a dependent on my tier 2 visa in 2013.

My daughter was born in the UK last year.

I have doubts on the following:

1- I understand that my wife is not eligible to apply for ILR at the same time as me. Having read on a few posts (old) it is suggested that she can extend her PBS dependent visa up to the time she becomes eligible for ilr. However, I cannot find a form for the same. They are all archived/withdrawn. Is this still a valid route? If so does she need a COS as I would no longer have a COS number myself.

2- Does she need to go through FLR (M) form for partner visa? I understand this would reset her clock which we do not want.

3- Can my daughter apply for registration as British citizen? If so, could you point me to the correct form please.

1. She can continue to extend her current visa until she qualifies for ILR. It is an online form, see Tier 2 General Dependents (click) and Tier 2 G Family Members (click). She does not need a CoS. She does have to pay the immigration health surcharge though.

2. If she switches to FLR(M), her clock towards ILR will be reset and she will have to wait 5 years on FLR(M) before she can apply for ILR. She will lose the time already spent as PBS dependent as she cannot combine this time with the FLR(M) time to make up 5 years residence.

3. Yes, as soon as you are granted ILR, you can apply to register your daughter under section 1(3) of the nationality act using form MN1. See Citizenship FAQs (click)

Dear CROO1,

Just wanted to let you know my ILR was approved yesterday at Croydon Premium Service centre.

The application was straightforward and document submitted was kept to a minimum.

I now need to apply for British Citizenship Registration for my daughter (1 year old). I have downloaded MN1 and the guidance. However, not much is said on the guidance about the supporting evidences/documents to be submitted with the application.

Having read the post which is dated 2012, I wonder if the docs are still the same, i.e.:
1. Birth Certificate of my Daughter
2. My biometric ILR card I suppose?

Please, let me know if there anything else I need to submit?

Dear Moderator,

I'd like to let you know have gone with your suggestion.

I have submitted my daughter's Citizenship registration application (MN1) via the NCS service.

Submitted date: 03/03/2016

Now waiting to hear back from them.

Also I have a doubt, from what I know and have read my wife does not need to switch to FLR (M) , she can continue to be on her current PBS dependent visa and renew up to the point when she covers 5 years then apply for ILR.

I heard some rules changed in 2014, would my wife be required to switch to FLR (M).

Just an update on my application:

I have emailed Nationality Enquiries at NationalityEnquiries@homeoffice.gsi.gov.uk today to track progress of the application.

I got go an auto response:

"IMPORTANT - PLEASE READ AS YOU WILL NOT RECEIVE ANOTHER RESPONSE
...How long will it take for my application to be decided?

Decisions on applications are usually made within six months...."

Really?

For the amount of money they take to process applications, could have done better, and there is no where for me to track the progress.

Dear Moderators,

My daughter has received her certificate of registration today, issued on 05/05/2016.

I now wish to apply for a Child UK passport for her to be able to travel. However, none of the parents have a British passport. I am only eligible to apply 1 year after being on ILR. I have the following doubts in mind:

1. Does one of the parent need to have a British passport for the child to be eligible to apply?

2. Will it be a problem for my wife who is still on the probationary period when I apply for a british passport? As in, will she have to switch to FLR(M) if I do get a British passport?

1. No, there is no such requirement. Your child is already British and the registration certificate is proof of that. You can apply for a child passport using the 1 week fast track service which costs a bit more than the normal fee.

2. No, as above, your child is registered as British. Your wife's status is not relevant.

Dear moderators,

Just an update on my daughter's pasport application: she has successfully received her passport after 3 weeks of waiting. Yipee! Many thanks for all your advice.

I have a small query however regarding my wife who is still on the probationary period until 2018 to apply for ILR. She wishes to start university education which she will be paying her fees for. I am not sure if her current visa will cause any problem and when it comes to extending her PBS dependent visa if that will be an issue. Do you envisage any issue that she may have?

No issue for your wife to study on her current visa. She will be charged international fees though and cannot benefit from the grants etc available.

Dear Moderator,

My wife is not extending her Tier 2 PBS dependant visa in order to cover the remaining years needed to be eligible for ILR.

I am on ILR as previously mentioned. However I have a query on the below which is coming up during application:

Whilst filling in the online form I am being asked to put the visa expiry date, in order to pay the NHS Health Surcharge, I am not too sure whether this would be the expiry date of my previous Tier 2 G visa or a potential date by when she will be eligible for ILR.

I'd be very grateful if you could help with the above query.

She is applying alone and I have selected the option as such when it tries to work out the NHS surcharge .

However, it does ask her to put th expiry date.

I have selected her visa route as 'Tier 2 PBS Dependant'. Is that correct? I am stuck on the visa expiry date at the moment. I can't find a way of starting over again and the answers are locked and expecting me to complete the IHS surcharge.

Dear CR001,

I have attached a screenshot just to show what I meant. Applying as a Tier 2 PBS dependent is requiring me to enter the person's details the dependent is joining/remaining with. And as such it asks for the visa expiry date of the person remaining with, which I have entered as 23/10/2016. This is the date on which my Tier 2 (main applicant) visa would have expired, but I am already on ILR.

Dear moderators / CR001,

I am now updating the thread after a while of being away. Just for completeness of this thread re-posting against the same instead of a new topic.

I have now lived in the UK after being 1 year on ILR, and eligible to naturalise.

My wife had successfully extended her PBS dependant visa since and my daughter naturalised as well.

I am thinking if it'll cause my wife any issue/complications in the future when she applies for ILR if I was to naturalise, which means giving up my ILR?
