Job creation - pre-6 April 2014

Job creation - pre-6 April 2014

Hi,

I will be applying for my visa extension. Just wanted to confirm what the rules are on Job creation and combinations.

As far as I am aware, the requirement for PRE-6 APRIL 2014;I only have to prove full-time job creation for a combined total of 24 months... on guidance it mentions ..
- one worker for 6 months and one for 18 months, is acceptable,
BUT...
if I have one full time worker for 9 months..
and other 2 part-time workers combined making up equivalent to one full time for 15 months
(i.e: 9 months for 1 job + 15 months for 2nd job)

Does that qualify to be acceptable by Home Office ??

I do not see how two part time workers working for 9 and 15 months constitutes 15 months of full time work given that HO ignores any extra hours worked beyond 30 hours a week. I would say that would add up to 12 months of full time work :?

hi
i am on preapril 2014 route.
preaparing 4 my extension by end of this month, plz carify zimba, below are workers hrs, will that fullfill HO requirement:
1) 1 worker FT for 8 months
2) 2nd worker fulltime for 10m
3) 3rd ft for 5months
4) 4th FT for 2 months
combined total is 25months full time, but when i calculate their total hrs it comes as:
1) although he did 130hrs but as HO takes only 120 so 120*8=960
2) 10*120=1200
3) 5*120=600
4) 2*120=240
total hrs: 3000
total hrs required are accc to my calculation (i may be wrong): 52weeks*30hrsperweek=1560hrs*2workers=3120

so i am short by 3120-3000=120hrs is that right zimba??
so do i have to do 24m of ft emloyment or 3120hrs which one?

You should not calculate the hours based on the months worked as the HO requirement of 3210 is calculated on the weekly basis. A month is not necessarily 4 weeks and therefore not always 120 hours.

Calculate the hours on the weekly basis (No of weeks worked) X (hours worked in the week)

To make my question clearer; please consider the following and tell me if that qualifies to be as per the rules.

1ST JOB/POST - 9 MONTHS
1 EMPLOYEE (FULL TIME)
[ 174hrs/month, i.e: 40hrs/WEEK) >> for 9 Months total = 39 weeks (1560 hours) ]

2ND JOB/POST - 15 MONTHS
2 PART-TIME EMPLOYEES (Covering the same job)
1 EMPLOYEE (18 hrs/WEEK) + 1 EMPLOYEE (16 hrs/WEEK) [Together, combined 34hrs/week]
[ 147hrs/month, i.e: 34hrs/WEEK) >> for 15 Months total = 65 weeks ( 2210 hours) ]


In my opinion, with the PRE-6 APRIL TRANSITIONAL ARRANGEMENTS, it should be fine. Please comment and guide me if I'm wrong.

I try to provide more details on the calculations based on the rules, however given the details you provided, I think you are eligible.
1ST JOB/POST - 9 MONTHS
1 EMPLOYEE (FULL TIME)
[ 174hrs/month, i.e: 40hrs/WEEK) >> for 9 Months total = 39 weeks (1560 hours) ]
You cannot claim more hours beyond 30 hours a week in a full time role. For this role you end up claiming only 1170 hours only.
The rules regarding the job creation clarify this in Appendix A:
49. A full time job is one involving at least 30 hours of work a week. Two or more part time jobs that add up to 30 hours a week will count as one full time job, and may score points in Tables 5 and 6, if both jobs exist for at least 12 months. However, one full time job of more than 30 hours work a week will not count as more than one full time job. If jobs are being combined, the employees being relied upon must be clearly identified by the applicant in their application. Jobs that have existed for less then 12 months cannot be combined together to make up a 12 month period.
2ND JOB/POST - 15 MONTHS
2 PART-TIME EMPLOYEES (Covering the same job)
1 EMPLOYEE (18 hrs/WEEK) + 1 EMPLOYEE (16 hrs/WEEK) [Together, combined 34hrs/week]
[ 147hrs/month, i.e: 34hrs/WEEK) >> for 15 Months total = 65 weeks ( 2210 hours) ]
The second position will be capped at 30 hours a week for 65 weeks which is 1950 hours worked. Add that to the 1170 hours above you will get 3120 hours required.

how do i calculate weekly hrs my payroll is run monthly,
from above plz tell me do i qualfy or not on preapril 2014?

It is impossible to have around 25 months of full time employment and not qualify !
Your mistake again is that you think a month is 4 weeks which in reality a month it is around 4.3 weeks :) so on average you end up with 129 hours worked per month. That is beyond 3120 hours required if you covered 25 months.
If you want the very accurate calculation, you need need to count the weeks and any days your employees worked and multiply that by hourly rate to get the exact value.

each worker worked 130 hrs per month but i m counting only 120 hrs as HO will neglect xtra 10hr u told me in last post,
if i take 130 hrs for each worker then i qualify, no problem.
so can i count 130hr each month or 120hr

I am repeating myself here and it seems you do not read my replies. As I can see it you covered 3120 hours but it seems that you still do not understand how to calculate the hours even when I explained it above
