Switching from tier 2 ICT dependant to tier 2 general

I am currently on Tier 2 ICT long term Dependant visa. I am working in a company for last 7 months. They got their tier 2 general sponsorship license recently and willing to sponsor me a tier 2 general visa. But the problem is they are very new to this visa sponsorship matter and they don’t know how to start the process for an existing employee. They are saying they need to run an advertisement for the position in a job portal for few days before issuing me the sponsorship but currently they don’t have any opening as well against which they can publish an advertisement. I am clueless now how to convince them or what shall I suggest them to do. Can anyone please help me with this situation.

Thanks for your response noajthan. But then what is the way forward in this case? My employer wants to give me the sponsorship to retain me. Are you saying there is no way a company can sponsor their existing employee a tier 2 general visa??

They can, but only if they conduct the full and proper RLMT process and have the evidence that there is no British/EU or ILR person available/suitable for the job.

What is the job that you are currently doing?

My/my employer's query is how they can post advertisement for my position as it is not vacant at the moment ?
They don't have any other opening as well. Basically how to start this RLMT process?

Employer has to create a post and see if they can fill it with a British/EU or ILR person Mobile QA specialist (there must be one out there somewhere).
If there's no vacancy in the company then clearly you can't have the job!
