I need urgent advise on refusal of my flr fp 2nd extension. I have read similar posts so could not find an answer to my questions so i thought i should post my new thread. Please i need urgent advice

I came in uk in 2009 on tier 4 visa and got married in 2012 , so i applied for spouse visa which got refused but i won the appeal and was issued 2.5 year leave under human rights in september 2013.

In may 2016 i put an application for flr fp extension which was refused yesterday (16 sep 2016, letter dated 13 sep 2016).

There is no obvious refusal , but they refused the application saying you have been in uk for 6 months so we believe you can continue your life in your home country with your british wife, which is totally wrong

i went paris 6 months ago for visit on schengen visa with my wife. (home office said you enter uk via paris and only been in uk for 6 months)

I have been legally staying in uk since 2009. My solicitor said we will write PAP to them and challege the decision

I would like your advice whether this is the right step by my solicitor. Moreover please tell me if i can work while my solicitor writes PAP to home office? As it says in letter you must leave the country after 7 days of receiving this letter and you are not allowed to work this is the most worrying thing as the letter was posted on 13 sep but we received on 16 sep does this means i have lost 3 days already

If there is any other option please please share with me.

I will really appreciate if you could please advise on below

1. As i am issued is.96 letter and we have also logged PAP and there are only 7 days more to go for PAP deadline. If i get a reconsideration say tomorrow , am i still liable to be detained. (e.g is consideration is positive in my favor)

2. If home office fails to respond in 14 days and if we log the JR on 16th day, am i still liable to be detained. Please provide answer on the above

The only thing which i want to avoid is detention

If you are married to a british citizen, the best option is to get schengen visa through french embassy, i got 6 month visa in 1st attemp all you need to do is

1. go on TLSContact website, make an account on TLS contact and fill in the schengen application form. but before you fill in the application form try to book yourself a hotel , just the reservation by going on booking.com and print that booking.

2. you then need a confirm return ticket for you and your partner, i booked airline ticket which was expensive but i would suggest you book eurostar return ticket, they are very cheap
3. Once you have the above, fill in details on TLS contact schengen visa form and print the form, select multiple visa option in schengen visa
4. you then need to book an appointment slot at TLS contact london and print the booking confirmation.
5. on the day take your british partner with you along with her passport. The person at TLS will look and stamp the copy of british partner's passport and you only need to submit the passport copy. They will not charge you any visa fee because you are a partner of british citizen, but they will charge you i guess 18 pounds for admin fee. you need two passport photos, details are on schengen visa. and all done

The must have is the confirm return ticket of you with your partner, which shows you are travelling together.

If home office gives me a reconsideration in next 2 days before i apply for JR. Can ho detain me. I missed 1 reporting already. My solicitor says they cant detain me but i want ur thoughts. Please reply i am so stressed

All i just received a fax from home office in reply to my PAP that they will reconsider my application in the next 3 months, so my solicitor told me we wont be filing JR as HO is going to reconsider my case.

Please tell me is this a good sign

My Solicitor says i am safe and we will await for their reconsideration decision, if it comes negative again we will file JR i wanted to know from you people and your experience.

In my case they already accepted that my relationship with my spouse is genuine, and the only refusal they gave me was "since you are living in uk for only 6 month, you and your partner will have no obstacle in returning back to your home country". Here we told HO in PAP that i am legally residing in uk since 2009 and have a look at last decision made by FTT and HO granted me 2.5 yrs visa, then how come i am here for only 6 month . I also attached mmy university degree which i achieve from 2009 till 2012.

HI,
As per your posts I would like to tell you no body can guarantee you will home office detain you or not when you go for signing. As now a days they can do anything, secondly about your PAP so far if you have pending something with home office they Dnt detain until any output come of your PAP. In some cases it has happens if God forbidden something negative come up on your PAP and you go for reporting so they can detain you and about reconsidration letter you can aspect anything in result could be possible they send you same result could be possible they give you appeal right in country could be possible they ask you to come for interview only thing I can say you need to Waite and see what they reply whatever I have mentioned here it's been happens to one of my friend he is going for reporting every two weeks no problem so far and he is waiting of his reconsideration as well and his flrm extension was refused with no appeal right

Thanks for your reply and yes its all a waiting game now, i have asked MP to write and letter and i am told to wait until they decide on the reconsideration, few days ago solictor wrote another letter for any update and still no response, christmas holidays are approaching and looks like if i dont get a response in a week time it will be delayed by a month

Reconsideration refused. Same copy paste refusals from original decision. They gave me in country right of appeal

Reconsideration refused. Copy and pasted same refusals as it was on original decision. Gave me in country right of appeal which we have actioned already.

just an update on my case

I received a letter from first tier tribunal that they have received my appeal and also they gave me a reference number. They also deducted 140 pounds.

can anybody please tell me if this is a good sign. E.g has court accepted my case and will now give me appeal hearing date.

2nd question is. Am i safe to go for reporting if i take the court letter with me?
