About Applying for EEA

Hello,

I am non EU National , but I will be marrying an EU National , she currently lives in UK with national insurance ,
My question is , i recently applied for a tier 4 student general visa and it got refused because of the insufficient funds for maintenance , can i apply after that refusal for an EEA Family permit , or they will consider that i just got refused recently and they might refuse the EEA as well ?

I am currently in UK this is true , but my other post was about applying for another visit visa to her country , so we can get married there and then apply for the EEA .

You should apply for a Romanian visa from your country of residence. UK is not your country of residence.

I have 2 sisters live in UK they are British Citizens , they are the reason of my family visit visa , i got 5 visit visas before , and i got one refused tier 4 student visa.
