EEA appeal tribunal and new EEA2 application in the same tim

In January we got a EEA family permit refused. Appealed and got the Tribunal on Tuesday.
We got married by islamic double proxy and were refused on the following reasons.
i did not excersise my treaty rught. not true i was! my department was taken over by another company.
Germany would not accept proxy marriage. Not true! Email from German embassy confirms that if the marriage is legal in the country where it was done. it is legal in Germany too.
They say the marriage was not registered within 4 weeks but it was registered in two weeks.

Now we got married at registrar's and put new application in.
Prior to this my husband was detained twice and is out on bail.
He has to sign every two weeks and obviously we are fed up of this.
Can going to the tribunal have a negative impact ? Is there anything that can make the situation worse?
90% of their reasons for refusal can be proved wrong. the other reasons cannot be proved by either of us, as they mention that i have been married to a Gambian before.

Shall we go to the tribunal or can it be an issue?
