Need Urgent adivce Please Please please HELPPPPPPPPPPPPPPPPP

Hi i am non EEA citizen but i have resident in spain. i am from asia and have a british Civil partnership we got our cicil partnership last Sept 2007. Since were living in spain our relationship is ruin. He want to divorce me for invalid reason. He just let me a side and treat us adifferent person, and even bitting me up. I still have visa for UK until Feb 4, 2008. and i have sister in and shes a citizen.

Question:

1. Do i have to UK and ask help from the HOme office.?
2. Do im allowed to stay in the UK?
3. What you can advice for me to do?and the best options?

A Civil Partnership is for same sex couples, is that what you mean?

1. No, if ur relationship has ended your visa is void. HO isn't interested.

2. No, as above.

3. If you have residency in Spain why not live there? Or return to your homeland.

Answer to 1) - the Home Office will not help you. You are not currently resident in the UK, so you have no argument to stay in the UK. There is less reason for them to let you enter.

In this case, your visa depends on your relationship. If the relationship is ended, the visa is no longer valid. If you are careful, you can enter the UK until the current visa expires, but you must leave before 05 February, or you will become an overstayer.

So, answer to 2) - NO. You are not allowed to stay in the UK.

3) -

Overstaying will cause you very serious problems in the UK and in the EU. If immigration marks you for overstaying a visa, all of your visa applications to most countries in the world will require you to explain that. And, many visa applications will be denied for that reason.

You say you are a resident of Spain. Is this residency yours? What does it depend on? How long is it valid?

Probably you should plan to stay in Spain until you can make other plans.

A visit visa is one type of visa. When did the visa begin? When this one ends, you must leave. It is usually used for tourism or to visit family only.


A civil partnership visa is a different type of visa.

We need to know which one you have. It is very important.


Also, did you ever have residence in the UK?

You may have a visitor visa
You may have a civil partnership.
It doesn't mean you have a visa that formalizes your stay in a legal way.
Do you have any visas in your passport issued from the home office.
They would be a sticker that takes up the whole page of your passport.

And tell your English friends to look at your passport so we can understand what your status is. Sure you can report him but that doesn't help your visa or legal status.

And what visa do you have from spain, you say you have residence. Now please note, residence, doesn't mean a home or a place to stay. It means you have a resident card issued by the government in Spain or they might put a large sticker in your passport like the UK. Is that what you have??
What does the visa say exactly about your status.
Write it out exactly the way you see it.

Please be very careful of advice given by friends. Most people, especially UK citizens without direct experience of UK immigration, have absolutely no understanding of immigration law.

Please give us the exact details of whatever is written in your passport from the UK or Spanish governments, or any documents in your name issued to you. We want to help you, as no-one deserves to be beaten by their partner, but we need to know about your situation, and also what you want.

Coming to the UK may not be an option, but you may be able to stay in Spain or return to your own country. Where are you from? You might be able to get some advice from your country's embassy.
