I am a Refugee can I sponsor my wife who is on student visa?

Hi All,

I was wondering if someone can help me, I tired to search the forum and FAQ section but couldn't find any answer to this.

I recently got married in the UK (last month). I have refugee status which is valid for another 3 years, my wife is an international student and she is on Tier 4 visa at the moment.

My question is can she become my dependent and can I become her sponsor? (bear that in mind I am still not holding ILR).

Pre-flight’ family members (i.e. spouse, civil partner, unmarried or same-sex partner and children under 18 who were part of the refugee sponsor’s family unit before s/he left their country of habitual residence) can apply to join them in the UK.21 There are no maintenance and accommodation requirements to satisfy. The family members become eligible for permanent settlement in line with the refugee sponsor.

Applications from ‘post-flight’ family members (including children conceived after the refugee left their country to claim asylum), and adult dependent relatives, are subject to the same requirements as applications from family members of British citizens and persons settled in the UK. Post-flight spouse and child applications submitted on or after 9 July 2012 are therefore subject to the new financial requirement.

We both in the UK and got married last month, my wife is on a valid Tier 4 student visa (until October 2014), so I guess she doesn't need to leave the country in order to apply for FLRM. Am I correct?

I have a situation here which I would like to get some answers please:

I have a refugee leave valid until Nov 2017. My partner is about to complete 30 months of flr m and we need to apply for another 30 months by December 2016.

I need to know is she going to get another 30 months on her leave or is UKVI going to give her permit to stay until my leave will end on Nov 2017?

I appreciate your response and sorry this was asked before.
